10 AN ACT
regulating traffic; concerning auxiliary driving lamps and fog
11 lamps; amending K.S.A.
8-1725 and repealing the existing section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section
1. K.S.A. 8-1725 is hereby amended to read as follows: 8-
15 1725. When a motor vehicle is being
operated on a highway or shoulder
16 adjacent thereto during the times specified
in K.S.A. 8-1703, and amend-
17 ments thereto, the driver shall use a
distribution of light, or composite
18 beam, directed high enough and of
sufficient intensity to reveal persons
19 and vehicles at a safe distance in advance
of the vehicle, subject to the
20 following requirements and limitations:
21 (a) When the
driver of a vehicle approaches an oncoming vehicle
22 within 500 feet, such driver shall use a
distribution of light, or composite
23 beam, so aimed that the glaring rays are
not projected into the eyes of
24 the oncoming driver. The lowermost
distribution of light, or composite
25 beam, specified in subsection (a)(2) of
K.S.A. 8-1724, and amendments
26 thereto, or subsection (b)(2) of K.S.A.
8-1805, and amendments thereto,
27 shall be dimmed to avoid glare at all
times, regardless of road contour
28 and loading.
29 (b) When the
driver of a vehicle approaches another vehicle from the
30 rear, within 300 feet, except when engaged
in the act of overtaking and
31 passing, such driver shall use a
distribution of light permissible under this
32 article other than the uppermost
distribution of light specified in subsec-
33 tion (a)(1) of K.S.A. 8-1724, and
amendments thereto, or subsection
34 (b)(1) of K.S.A. 8-1805, and amendments
thereto.
35 (c)
(1) When the driver of a vehicle approaches an
oncoming vehicle
36 within 500 feet, or approaches another
vehicle from the rear within 300
37 feet, such driver shall turn off any
auxiliary driving lamps or fog lamps.
38 (2) From and
after the effective date of this act and prior to
39 July 1, 2001, a law enforcement officer
shall issue a warning cita-
40 tion to anyone violating the provisions
of this subsection.
41 (c)
(d) The requirements in subsections (a) and (b) shall
not apply to
42 authorized emergency vehicles displaying
alternately flashing or simul-
43 taneously flashing head lamps as provided
in K.S.A. 8-1720, and amend-

1 ments thereto.
2 Sec. 2. K.S.A. 8-1725 is
hereby repealed.
3 Sec. 3. This act
shall take effect and be in force from and after its
4 publication in the statute book.
