  9             AN  ACT regulating traffic; concerning auxiliary driving lamps and fog
10             lamps; amending K.S.A. 8-1719 and repealing the existing section.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. K.S.A. 8-1719 is hereby amended to read as follows: 8-
14       1719. (a) Spot lamps. Any motor vehicle may be equipped with not to
15       exceed two (2) spot lamps. Every lighted spot lamp emitting a white light
16       shall be so aimed and used that no part of the high intensity portion of
17       the beam will strike the windshield, or any windows, mirror or occupant
18       of another vehicle in motion. The limitations of this subsection shall not
19       apply to a police vehicle used as an authorized emergency vehicle.
20             (b) Fog lamps. Any motor vehicle may be equipped with not to exceed
21       two (2) fog lamps mounted on the front at a height not less than twelve
22       (12) 12 inches nor more than thirty (30) 30 inches above the level surface
23       upon which the vehicle stands and so aimed that when the vehicle is not
24       loaded none of the high intensity portion of the light to the left of the
25       center of the vehicle shall project, at a distance of twenty-five (25) 25 feet
26       ahead, higher than a level of four (4) inches below the level of the center
27       of the lamp from which it comes. Lighted fog lamps meeting the above
28       requirements may be used with lower head lamp beams as specified in
29       subsection (a) (2) of K.S.A. 8-1724, and amendments thereto. In addition
30       to any other limitations, fog lamps shall be lighted only when unfavorable
31       atmospheric conditions exist. Unfavorable atmospheric conditions include
32       mist, rain, snow, fog, sleet or dust in the atmosphere.
33             (c) Auxiliary passing lamps. Any motor vehicle may be equipped with
34       not to exceed two (2) auxiliary passing lamps mounted on the front at a
35       height not less than twenty-four (24) 24 inches nor more than forty-two
36       (42) 42 inches above the level surface upon which the vehicle stands. The
37       provisions of K.S.A. 8-1724, and amendments thereto, shall apply to any
38       combination of head lamps and auxiliary passing lamps.
39             (d) Auxiliary driving lamps. Any motor vehicle may be equipped with
40       not to exceed two (2) auxiliary driving lamps mounted on the front at a
41       height not less than sixteen (16) 16 inches nor more than forty-two (42)
42       42 inches above the level surface upon which the vehicle stands. The
43       provisions of K.S.A. 8-1724, and amendments thereto, shall apply to any

  1       combination of head lamps and auxiliary driving lamps. In addition to any
  2       other limitations, auxiliary driving lamps shall be lighted only when un-
  3       favorable atmospheric conditions exist. Unfavorable atmospheric condi-
  4       tions include mist, rain, snow, fog, sleet or dust in the atmosphere.  
  5       Sec.  2. K.S.A. 8-1719 is hereby repealed.
  6        Sec.  3. This act shall take effect and be in force from and after its
  7       publication in the statute book.
