9 AN ACT relating to the practice of pharmacy; refusal to fill a
10 prescription.

12 Be it enacted by the Legislature of the State of Kansas:
13 Section 1. (a) No pharmacist shall be required to fill and dispense
14 medication pursuant to a valid prescription if the pharmacist objects be-
15 cause of professional duty or as a matter of conscience on moral, ethical
16 or religious grounds if there is reason to believe that the medication will
17 be used to:
18 (1) cause an abortion;
19 (2) cause the abortion of a human zygote;
20 (3) destroy an unborn child;
21 (4) cause the death of any person by means of an assisted suicide,
22 euthanasia or mercy killing.
23 (b) There shall be no liability on the part of and no action for damages
24 shall arise against any pharmacist or pharmacy based upon a pharmacist's
25 refusal to fill a prescription and dispense such medication pursuant to
26 subsection (a).
27 (c) Such refusal to dispense prescribed medication pursuant to sub-
28 section (a) may not be the basis for any disciplinary, recriminatory or
29 discriminatory action against a pharmacist with a claim of conscience.
30 Sec. 2. This act shall take effect and be in force from and after its
31 publication in the statute book.
