  9             AN  ACT concerning the rights of residents of retirement communities
10             to be represented on boards and committees of such communities.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) If the developer of a Kansas retirement subdivision or
14       community is incorporated under Kansas statutes as a nonprofit corpo-
15       ration and such corporation governs the management of the retirement
16       subdivision, the following shall apply:
17             (1) The residents, purchasers or lessees of lands or units in the sub-
18       division or community shall annually have the opportunity to democrat-
19       ically select and designate one or more individuals, not to exceed 13 the
20       number of other members of the governing body, to represent the resi-
21       dents, purchasers and lessees and to act as members of the governing
22       body of the corporation. The representatives shall have the right to be
23       present at all meetings, including committee meetings and executive ses-
24       sions, of the governing body, to speak and express opinions, and to vote
25       on any of the business to come before the governing body. The repre-
26       sentatives shall be deemed to have been duly installed and to have their
27       terms commence on their election;
28             (2) the election shall be conducted in total by the residents, pur-
29       chasers and lessees, described in paragraph (1) pursuant to rules adopted
30       by them in open session; and
31             (3) the developer shall in no way attempt to interfere with, influence
32       or abridge the right of the residents, lessees and purchasers to organize
33       and conduct the election or results of the election.
34             (b) Violation of this section is a class B nonperson misdemeanor.
35        Sec.  2. This act shall take effect and be in force from and after its
36       publication in the statute book.
