9 AN ACT relating to motor vehicles; concerning educational institution
10 license plates; amending K.S.A. 1998 Supp. 8-1,141 and 8-1,142 and
11 repealing the existing sections.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. K.S.A. 1998 Supp. 8-1,141 is hereby amended to read as
15 follows: 8-1,141. (a) Any new distinctive license plate authorized for is-
16 suance on and after July 1, 1994, shall be subject to the personalized
17 license plate fee prescribed by subsection (c) of K.S.A. 8-132, and amend-
18 ments thereto. This section shall not apply to any distinctive license plate
19 authorized prior to July 1, 1994.
20 (b) The director of vehicles shall not issue any new distinctive license
21 plate authorized for issuance on and after July 1, 1995, unless there is a
22 guarantee of an initial issuance of at least 500 license plates.
23 (c) The provisions of this section shall not apply to distinctive license
24 plates issued under the provisions of K.S.A. 1998 Supp. 8-1,145, and
25 amendments thereto.
26 (d) The provisions of subsection (a), shall not apply to distinctive li-
27 cense plates issued under the provisions of K.S.A. 1998 Supp. 8-1,142,
28 and amendments thereto.
29 Sec. 2. K.S.A. 1998 Supp. 8-1,142 is hereby amended to read as fol-
30 lows: 8-1,142. (a) As used in this section, "educational institution" means:
31 (1) Any state educational institution under the control and supervi-
32 sion of the state board of regents;
33 (2) any qualified institution as defined in K.S.A. 72-6107, and amend-
34 ments thereto;
35 (3) any community college organized and operating under the laws
36 of this state; and
37 (4) Haskell Indian Nations university.
38 (b) Any owner or lessee of one or more passenger vehicles or trucks
39 registered for a gross weight of not more than 12,000 pounds who is a
40 resident of Kansas, upon compliance with the provisions of this section,
41 may be issued one educational institution license plate for each such pas-
42 senger vehicle or truck. Such license plates shall be issued for the same
43 period of time as other license plates upon proper registration and pay-

1 ment of the regular license fee as provided in K.S.A. 8-143, and amend-
2 ments thereto, plus the payment of an additional fee of $5 for each plate,
3 and the presentation of the annual emblem use authorization statement
4 provided for in subsection (c).
5 (c) Any educational institution may authorize through its officially
6 recognized alumni association or foundation the use of such institution's
7 official emblems to be affixed on license plates as provided by this section.
8 Any royalty payment to such alumni association or foundation derived
9 from this section, except reasonable administrative costs, shall be used
10 for recognition of academic achievement or excellence subject to the ap-
11 proval of the chancellor or president of the educational institution. Any
12 motor vehicle owner or lessee may annually apply to the alumni associa-
13 tion or foundation for the use of the institution's emblems. Upon annual
14 application and payment to the alumni association or foundation in an
15 amount of not less than $25 nor more than $100 as an emblem use royalty
16 payment for each educational institution license plate to be issued, the
17 alumni association or foundation shall issue to the motor vehicle owner
18 or lessee, without further charge, an emblem use authorization statement,
19 which shall be presented by the motor vehicle owner or lessee at the time
20 of registration.
21 (d) Any applicant for an educational institution license plate may
22 make application for such plates not less than 60 days prior to such per-
23 son's renewal of registration date, on a form prescribed and furnished by
24 the director of vehicles, and any applicant for the educational institution
25 license plates shall provide the annual emblem use authorization state-
26 ment provided for in subsection (c). Application for registration of a pas-
27 senger vehicle or truck and issuance of the license plates under this sec-
28 tion shall be made by the owner or lessee in a manner prescribed by the
29 director of vehicles upon forms furnished by the director and accompa-
30 nied by a fee of $25, which shall be in addition to any other fee required
31 by law.
32 (e) An applicant for an educational institution license plate under this
33 section may be issued a personalized educational institution license plate
34 subject to the conditions and fees prescribed in subsection (c) of K.S.A. 8-
35 132, and amendments thereto. A personalized educational license plate
36 shall not be subject to the $25 fee required by subsection (d).
37 (e) (f) No registration or educational institution license plate issued
38 under this section shall be transferable to any other person.
39 (f) (g) Renewals of registration under this section shall be made an-
40 nually, upon payment of the fee prescribed in subsection (b), in the man-
41 ner prescribed in subsection (b) of K.S.A. 8-132, and amendments
42 thereto. No renewal of registration shall be made to any applicant until
43 such applicant provides the annual emblem use authorization statement

1 provided for in subsection (c). If such emblem use authorization state-
2 ment is not presented at the time of registration, the applicant shall be
3 required to comply with K.S.A. 8-143, and amendments thereto, and re-
4 turn the educational institution license plates to the county treasurer of
5 such person's residence.
6 (g) (h) The director of vehicles shall not issue any educational insti-
7 tution license plates for any educational institution, unless such educa-
8 tional institution's alumni association or foundation guarantees the initial
9 issuance of at least 500 license plates. The issuance cycle for each edu-
10 cational institution's license plates shall begin with the number one and
11 if any educational institution's current issuance cycle did not begin with
12 number one, the division of vehicles shall implement an issuance cycle for
13 such educational institutions beginning with the number one.
14 (h) (i) Each educational institution's alumni association or foundation
15 shall:
16 (1) Pay the initial cost of silk-screening for such educational license
17 plates; and
18 (2) provide to all county treasurers a toll-free telephone number
19 where applicants can call the alumni association or foundation for infor-
20 mation concerning the application process or the status of their license
21 plate application.
22 (i) (j) Except for personalized educational license plates under sub-
23 section (e), each educational institution's alumni association or foundation,
24 with the approval of the director of vehicles superintendent of the high-
25 way patrol and subject to the availability of materials and equipment,
26 shall design a license plate to be issued under the provisions of this sec-
27 tion. Such license plate design shall include: (1) Kansas centered at the
28 top of the plate; and (2) except for trucks, appropriate space at the bottom
29 of the plate for the name of the educational institution to appear.
30 (k) The division of vehicles is hereby directed to cooperate with each
31 educational institution to expand the use of the educational license plate
32 program and to allow each educational institution to achieve the broadest
33 possible participation. The division shall also aid in the promotion of the
34 educational license plate program to encourage the broadest possible par-
35 ticipation.
36 Sec. 3. K.S.A. 1998 Supp. 8-1,141 and 8-1,142 are hereby repealed.
37 Sec. 4. This act shall take effect and be in force from and after its
38 publication in the statute book.
