  9             AN  ACT concerning certain electric public utilities; relating to certain
10             contracts.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) As used in this section:
14             (1) "Certified territory" has the meaning provided by K.S.A. 66-1,170
15       and amendments thereto.
16             (2) "Electric public utility" means an electric public utility, as defined
17       by K.S.A. 66-101a and amendments thereto, the rates of which are reg-
18       ulated by the state corporation commission.
19             (3) "Off-system sales contract" means any contract for sale of electric
20       generation service that is not subject to rate regulation by the state cor-
21       poration commission.
22             (b) Any off-system sales contract entered into by an electric public
23       utility on and after the effective date of this act shall include a clause
24       providing for interruption of service under the contract whenever the
25       utility cannot supply sufficient generation service to fulfill the utility's
26       obligation to supply generation service to ratepayers within the utility's
27       certified territory.
28             (c) The provisions of this section shall not apply to contracts for sale
29       of electric generation service produced by generation facilities the con-
30       struction of which commences on or after the effective date of this act.
31        Sec.  2. This act shall take effect and be in force from and after its
32       publication in the Kansas register.
