  9             AN  ACT relating to motor vehicle insurance; concerning accident pre-
10             vention courses; amending K.S.A. 40-1112a and repealing the existing
11             section.

13       Be it enacted by the Legislature of the State of Kansas:
14             Section  1. K.S.A. 40-1112a is hereby amended to read as follows: 40-
15       1112a. (a) Any rates, rating schedules, or rating manuals for the liability,
16       personal injury protection, and collision coverages of a motor vehicle in-
17       surance policy submitted to or filed with the insurance commissioner shall
18       provide for an appropriate reduction in premium charges as to such cov-
19       erages for a two-year three-year period after the principal operator of the
20       covered vehicle successfully completes a motor vehicle accident preven-
21       tion course approved by the national safety council or a governmental
22       agency such as the state board of education. The rates, rating schedule
23       or rating manuals required by subsection (a) shall be submitted to or filed
24       with the commissioner of insurance at the time of the next regular filing
25       with the commissioner after the effective date of this act. Any discount
26       used by an insurer shall be presumed appropriate unless credible data
27       demonstrates otherwise. Only one discount shall be allowed for each qual-
28       ified person.
29             (b) The premium reduction required by this section shall be effective
30       for an insured for a two-year three-year period after successful comple-
31       tion of the approved course, except that the insurer may require, as a
32       condition of providing and maintaining the discount, that the insured for
33       a two-year three-year period after course completion not be involved in
34       an accident for which the insured is at fault, nor be convicted of more
35       than one moving violation.
36             (c) Upon successfully completing the approved course, each person
37       shall be issued a certificate by the organization offering the course which
38       shall be used to qualify for the premium discount required by this section.
39             (d) This section shall not apply in the event the approved course is
40       specified by an administrative order of the director of vehicles or by a
41       court order as a result of a moving traffic violation.
42             (e) Each participant shall take an approved course every two three
43       years to continue to be eligible for the reduction in premiums. 
44       Sec.  2. K.S.A. 40-1112a is hereby repealed.
45        Sec.  3. This act shall take effect and be in force from and after its
46       publication in the statute book.
