9 AN ACT concerning insurance; limitation on payments under certain
10 circumstances.

12 Be it enacted by the Legislature of the State of Kansas:
13 Section 1. (a) Notwithstanding any other provision of law, from and
14 after the effective date of this act, no individual or group health insurance
15 policy, medical service plan, contract, hospital and medical service cor-
16 poration contract, fraternal benefit society or health maintenance organ-
17 ization which provides coverage for accident and health services and
18 which is delivered, issued for delivery, amended or renewed on or after
19 the effective date of this act shall be required to provide coverage for any
20 individual who is at least 18 years of age and who:
21 (1) Has been convicted of a crime; and
22 (2) is being incarcerated in any jail or corrections institution for a
23 period of 30 or more consecutive days.
24 (b) Nothing in subsection (a) shall affect in any way the coverage
25 provided for any family member of the enrollee, insured or subscriber by
26 any individual or group health insurance policy, medical service plan,
27 contract, hospital and medical service corporation contract, fraternal ben-
28 efit society or health maintenance organization which provides coverage
29 for accident and health services.
30 (c) No individual or group health insurance policy, medical service
31 plan, contract, hospital and medical service corporation contract, fraternal
32 benefit society or health maintenance organization which provides cov-
33 erage for accident and health services and which is delivered, issued for
34 delivery, amended or renewed on or after the effective date of this act
35 shall be required to provide coverage for accident and health services to
36 any person who has been convicted of a crime and incarcerated as de-
37 scribed in subsection (a) of this section and subsequently released from
38 custody.
39 Sec. 2. This act shall take effect and be in force from and after Jan-
40 uary 1, 2000 and its publication in the statute book.
