  9             AN  ACT concerning rendering plants; relating to acceptance of certain
10             refuse.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) As used in this section, "refuse" has the meaning pro-
14       vided by K.S.A. 47-1214 and amendments thereto.
15             (b) Except to the extent otherwise prohibited by federal law, a ren-
16       dering plant shall be required to either:
17             (1) Accept from packing plants refuse from any species of animal; or
18             (2) reimburse the operator of a packing plant for reasonable costs
19       incurred to dispose of refuse from any species of animal that the render-
20       ing plant refuses to accept.
21             (c) The operator of a packing plant may bring an action to enforce
22       the provisions of this section and to recover any damages resulting from
23       the failure of a rendering plant to comply with the provisions of this
24       section.
25        Sec.  2. This act shall take effect and be in force from and after its
26       publication in the statute book.
