AN ACT concerning adoption; relating to birth
certificates; amending
10 K.S.A. 59-2119 and
K.S.A. 1997 Supp. 65-2423 and repealing the ex-
11 isting sections.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section 1. K.S.A.
59-2119 is hereby amended to read as follows:
15 59-2119. The district court shall report
the adoption to the state registrar
16 of vital statistics. The report shall
include an order to the state registrar
17 not to order issuance of a supplementary
certificate of birth in the new
18 name of the adopted person with the
names of the adoptive parents as
19 provided in K.S.A. 65-2423 and
amendments thereto, when the court de-
20 termines that it is in the best
interests of the child that the original cer-
21 tificate of birth remain in
effect.
22 Sec. 2. K.S.A. 1997
Supp. 65-2423 is hereby amended to read as
23 follows: 65-2423. (a) Except as provided
in K.S.A. 59-2119 and amend-
24 ments thereto, in cases of adoption
the state registrar upon receipt of a
25 certified decree of adoption, or a similar
document or documents which
26 evidences finalization of the adoption in
the foreign country, and the
27 report of adoption form shall prepare a
supplementary certificate in the
28 new name of the adopted person and seal and
file the original certificate
29 of birth with such certified copy attached
thereto. Such sealed documents
30 may be opened by the state registrar only
upon the demand of the
31 adopted person if of legal age or by an
order of court. Upon receipt of a
32 certified copy of a court order of
annulment of adoption the state registrar
33 shall restore the original certificate to
its original place in the files.
34 (b) For any child born
in a foreign country but adopted in Kansas or
35 born and adopted in a foreign country and
such adoption is filed and
36 entered pursuant to K.S.A. 59-2144, and
amendments thereto, the state
37 registrar, upon request, shall complete and
register a birth certificate
38 upon receipt of a certified copy of the
decree of adoption, or a similar
39 document or documents which evidences
finalization of the adoption in
40 the foreign country, the report of adoption
form and proof of the date
41 and place of the child's birth. The
certificate shall show the new name of
42 the child as specified in the decree of
adoption, or a similar document or
43 documents which evidences finalization of
the adoption in the foreign

1 country, and such further information
concerning the adopting parents
2 as may be necessary to complete the
birth certificate. The certificate shall
3 show the true country of birth and
the date of birth of the child, and that
4 the certificate is not evidence of
United States citizenship.

Sec. 3. K.S.A. 59-2119 and K.S.A. 1997 Supp. 65-2423 are
hereby
6 repealed.
7 Sec. 4. This
act shall take effect and be in force from and after its
8 publication in the statute book.
