            9             AN ACT concerning the uniform controlled substances act; relating to
10             unlawful acts; amending K.S.A. 1997 Supp. 65-4111, 65-4113, 65-
11             4160, 65-4161, 65-4162 and 65-4163 and repealing the existing
12             sections.
13            
14       Be it enacted by the Legislature of the State of Kansas:
15           Section 1. K.S.A. 1997 Supp. 65-4111 is hereby amended to read as
16       follows: 65-4111. (a) The controlled substances listed in this section are
17       included in schedule IV and the number set forth opposite each drug or
18       substance is the DEA controlled substances code which has been assigned
19       to it.
20           (b) Any material, compound, mixture or preparation which contains
21       any quantity of the following substances including its salts, isomers and
22       salts of isomers whenever the existence of such salts, isomers and salts of
23       isomers is possible within the specific chemical designation and having a
24       potential for abuse associated with a depressant effect on the central
25       nervous system:

33           (c) Any material, compound, mixture, or preparation which contains
34       any quantity of fenfluramine (1670), including its salts, isomers (whether
35       optical, position or geometric) and salts of such isomers, whenever the
36       existence of such salts, isomers and salts of isomers is possible. The pro-
37       visions of this subsection (c) shall expire on the date fenfluramine and its
38       salts and isomers are removed from schedule IV of the federal controlled
39       substances act (21 United States code 812; 21 code of federal regulations
40       1308.14).
41           (d) Unless specifically excepted or unless listed in another schedule,
42       any material, compound, mixture or preparation which contains any quan-
43       tity of the following substances having a stimulant effect on the central

  1       nervous system, including its salts, isomers (whether optical, position or
  2       geometric) and salts of such isomers whenever the existence of such salts,
  3       isomers and salts of isomers is possible within the specific chemical des-
  4       ignation:
  5                 (1) Cathine (( + )-norpseudoephedrine)  1230

14           The provisions of this subsection (d)(8) shall expire on the date phen-
15       termine and its salts and isomers are removed from schedule IV of the
16       federal controlled substances act (21 United States code 812; 21 code of
17       federal regulations 1308.14).

20           (e) Unless specifically excepted or unless listed in another schedule,
21       any material, compound, mixture or preparation which contains any quan-
22       tity of the following, including salts thereof:
23                 (1) Pentazocine ..................... 9709
24           (f) Unless specifically excepted or unless listed in another schedule,
25       any material, compound, mixture or preparation containing any of the
26       following narcotic drugs, or their salts calculated as the free anhydrous
27       base or alkaloid, in limited quantities as set forth below:
28                 (1) Not more than 1 milligram of difenoxin and not less than
29                                                   25 micrograms of atropine sulfate per dosage unit  9167
30                 (2) Dextropropoxyphene (propoxyphene or alpha-( + )-4-dimethylamino-
31                                                   1,2-diphenyl-3- methyl-2-propionoxybutane)  9278
32           (g) Butyl nitrite and its salts, isomers, esters, ethers or their salts.
33           (h) The board may except by rule and regulation any compound, mix-
34       ture or preparation containing any depressant substance listed in subsec-
35       tion (b) from the application of all or any part of this act if the compound,
36       mixture or preparation contains one or more active medicinal ingredients
37       not having a depressant effect on the central nervous system, and if the
38       admixtures are included therein in combinations, quantity, proportion or
39       concentration that vitiate the potential for abuse of the substances which
40       have a depressant effect on the central nervous system.
41           Sec. 2. K.S.A. 1997 Supp. 65-4113 is hereby amended to read as
42       follows: 65-4113. (a) The controlled substances or drugs, by whatever
43       official name, common or usual name, chemical name or brand name

  1       designated, listed in this section are included in schedule V.
  2           (b) Unless specifically excepted or unless listed in another schedule,
  3       any material, compound, mixture or preparation containing the following
  4       narcotic drug or its salts:
  5                 Buprenorphine ....................... 9064
  6           (c) Any compound, mixture or preparation containing limited quan-
  7       tities of any of the following narcotic drugs which also contains one or
  8       more nonnarcotic active medicinal ingredients in sufficient proportion to
  9       confer upon the compound, mixture or preparation valuable medicinal
10       qualities other than those possessed by the narcotic drug alone:
11           (1) Not more than 200 milligrams of codeine or any of its salts per
12       100 milliliters or per 100 grams.
13           (2) Not more than 100 milligrams of dihydrocodeine or any of its salts
14       per 100 milliliters or per 100 grams.
15           (3) Not more than 100 milligrams of ethylmorphine or any of its salts
16       per 100 milliliters or per 100 grams.
17           (4) Not more than 2.5 milligrams of diphenoxylate and not less than
18       25 micrograms of atropine sulfate per dosage unit.
19           (5) Not more than 100 milligrams of opium per 100 milliliters or per
20       100 grams.
21           (6) Not more than .5 milligram of difenoxin (9168) and not less than
22       25 micrograms of atropine sulfate per dosage unit.
23           (d) Unless specifically excepted or unless listed in another schedule,
24       any material, compound, mixture or preparation which contains any quan-
25       tity of the following substances having a stimulant effect on the central
26       nervous system, including its salts, isomers (whether optical, position or
27       geometric) and salts of such isomers whenever the existence of such salts,
28       isomers and salts of isomers is possible within the specific chemical des-
29       ignation:
30           (1) Propylhexedrine (except when part of a compound used for nasaldecongestion which is authorized to be sold lawfully over the counterwithout a prescription under the federal food, drug and cosmetic act,so long as it is used only for such purpose) 8161
31           (2)Pyrovalerone 1485
32           (e) Unless specifically excepted or unless listed in another schedule,
33       any product  &nbspc/ontaining as its single ingredient the substance Ephedrine,
34       compound, mixture, material or preparation which contains ephedrine or
35       its salts, optical isomers, or salts of optical isomers as the only active
36       medicinal ingredient or therapeutically insignificant quantities of another
37       active medicinal ingredient.
38           Sec. 3. K.S.A. 1997 Supp. 65-4160 is hereby amended to read as
39       follows: 65-4160. (a) Except as authorized by the uniform controlled sub-
40       stances act, it shall be unlawful for any person to possess or have under

  1       such person's control any opiates, opium or narcotic drugs, any depressant
  2       designated in subsections (b)(20), (b)(33), (b)(49) or (b)(50) of K.S.A.
  3       65-4111 and amendments thereto, or any stimulant designated in subsec-
  4       tion (d)(1), (d)(3) or (f)(1) of K.S.A. 65-4107 and amendments thereto.
  5       Except as provided in subsections (b) and (c), any person who violates
  6       this subsection shall be guilty of a drug severity level 4 felony.
  7           (b) If any person who violates this section has one prior conviction
  8       under this section or a conviction for a substantially similar offense from
  9       another jurisdiction, then that person shall be guilty of a drug severity
10       level 2 felony.
11           (c) If any person who violates this section has two or more prior
12       convictions under this section or substantially similar offenses under the
13       laws of another jurisdiction, then such person shall be guilty of a drug
14       severity level 1 felony.
15           (d) It shall not be a defense to charges arising under this section that
16       the defendant was acting in an agency relationship on behalf of any other
17       party in a transaction involving a controlled substance.
18           (e) For purposes of the uniform controlled substances act, the pro-
19       hibitions contained in this section shall apply to controlled substance an-
20       alogs as defined in subsection (bb) of K.S.A. 65-4101 and amendments
21       thereto.
22           (f) The provisions of this section shall be part of and supplemental to
23       the uniform controlled substances act.
24           Sec. 4. K.S.A. 1997 Supp. 65-4161 is hereby amended to read as
25       follows: 65-4161. (a) Except as authorized by the uniform controlled sub-
26       stances act, it shall be unlawful for any person to sell, offer for sale or
27       have in such person's possession with intent to sell, deliver or distribute;
28       prescribe; administer; deliver; distribute; dispense or compound any opi-
29       ates, opium or narcotic drugs, or any depressant designated in subsections
30       (b)(20), (b)(33), (b)(49) or (b)(50) of K.S.A. 65-4111 and amendments
31       thereto, or any stimulant designated in subsection (d)(1), (d)(3) or (f)(1)
32       of K.S.A. 65-4107 and amendments thereto. Except as provided in sub-
33       sections (b), (c) and (d), any person who violates this subsection shall be
34       guilty of a drug severity level 3 felony.
35           (b) If any person who violates this section has one prior conviction
36       under this section or a conviction for a substantially similar offense from
37       another jurisdiction, then that person shall be guilty of a drug severity
38       level 2 felony.
39           (c) If any person who violates this section has two or more prior
40       convictions under this section or substantially similar offenses under the
41       laws of another jurisdiction, then such person shall be guilty of a drug
42       severity level 1 felony.
43           (d) Notwithstanding any other provision of law, upon conviction of

  1       any person for a first offense pursuant to subsection (a), such person shall
  2       be guilty of a drug severity level 2 felony if such person is 18 or more
  3       years of age and the substances involved were possessed with intent to
  4       sell, deliver or distribute; sold or offered for sale in or on, or within 1,000
  5       feet of any school property upon which is located a structure used by a
  6       unified school district or an accredited nonpublic school for student in-
  7       struction or attendance or extracurricular activities of pupils enrolled in
  8       kindergarten or any of the grades one through 12.
  9           Nothing in this subsection shall be construed as requiring that school
10       be in session or that classes are actually being held at the time of the
11       offense or that children must be present within the structure or on the
12       property during the time of any alleged criminal act. If the structure or
13       property meets the description above, the actual use of that structure or
14       property at the time alleged shall not be a defense to the crime charged
15       or the sentence imposed.
16           (e) It shall not be a defense to charges arising under this section that
17       the defendant was acting in an agency relationship on behalf of any other
18       party in a transaction involving a controlled substance.
19           (f) For purposes of the uniform controlled substances act, the pro-
20       hibitions contained in this section shall apply to controlled substance an-
21       alogs as defined in subsection (bb) of K.S.A. 65-4101 and amendments
22       thereto.
23           (g) The provisions of this section shall be part of and supplemental
24       to the uniform controlled substances act.
25           Sec. 5. K.S.A. 1997 Supp. 65-4162 is hereby amended to read as
26       follows: 65-4162. (a) Except as authorized by the uniform controlled sub-
27       stances act, it shall be unlawful for any person to possess or have under
28       such person's control:
29           (1) Any depressant designated in subsection (e) of K.S.A. 65-4105,
30       subsection (e) of K.S.A. 65-4107, subsection (b) or (c) of K.S.A. 65-4109
31       or subsection (b) of K.S.A. 65-4111 other than subsections (b)(20), (b)(33),
32       (b)(49) or (b)(50), and amendments thereto;
33           (2) any stimulant designated in subsection (f) of K.S.A. 65-4105, sub-
34       section (d)(2), (d)(4) or (f)(2) of K.S.A. 65-4107 or subsection (e) of K.S.A.
35       65-4109, and amendments thereto;
36           (3) any hallucinogenic drug designated in subsection (d) of K.S.A. 65-
37       4105 and amendments thereto or designated in subsection (g) of K.S.A.
38       65-4107 and amendments thereto;
39           (4) any substance designated in subsection (g) of K.S.A. 65-4105, and
40       amendments thereto, and designated in subsection (c), (d), (e), (f) or (g)
41       of K.S.A. 65-4111 and amendments thereto; or
42           (5) any anabolic steroids as defined in subsection (f) of K.S.A. 65-
43       4109, and amendments thereto.

  1           Except as otherwise provided, any person who violates this subsection
  2       shall be guilty of a class A nonperson misdemeanor. If any person has a
  3       prior conviction under this section, a conviction for a substantially similar
  4       offense from another jurisdiction or a conviction of a violation of an or-
  5       dinance of any city or resolution of any county for a substantially similar
  6       offense if the substance involved was marijuana or tetrahydrocannabinol
  7       as designated in subsection (d) of K.S.A. 65-4105 and amendments
  8       thereto, then such person shall be guilty of a drug severity level 4 felony.
  9           (b) It shall not be a defense to charges arising under this section that
10       the defendant was acting in an agency relationship on behalf of any other
11       party in a transaction involving a controlled substance.
12           (c) For purposes of the uniform controlled substances act, the pro-
13       hibitions contained in this section shall apply to controlled substance an-
14       alogs as defined in subsection (bb) of K.S.A. 65-4101 and amendments
15       thereto.
16           (d) The provisions of this section shall be part of and supplemental
17       to the uniform controlled substances act.
18           Sec. 6. K.S.A. 1997 Supp. 65-4163 is hereby amended to read as
19       follows: 65-4163. (a) Except as authorized by the uniform controlled sub-
20       stances act, it shall be unlawful for any person to sell, offer for sale or
21       have in such person's possession with the intent to sell, deliver or distrib-
22       ute; cultivate; prescribe; administer; deliver; distribute; dispense or com-
23       pound:
24           (1) Any depressant designated in subsection (e) of K.S.A. 65-4105,
25       subsection (e) of K.S.A. 65-4107, subsection (b) or (c) of K.S.A. 65-4109
26       or subsection (b) of K.S.A. 65-4111 other than subsections (b)(20),(b)(33),
27       (b)(49) or (b)(50), and amendments thereto;
28           (2) any stimulant designated in subsection (f) of K.S.A. 65-4105, sub-
29       section (d)(2), (d)(4) or (f)(2) of K.S.A. 65-4107 or subsection (e) of K.S.A.
30       65-4109, and amendments thereto;
31           (3) any hallucinogenic drug designated in subsection (d) of K.S.A. 65-
32       4105, and amendments thereto or designated in subsection (g) of K.S.A.
33       65-4107 and amendments thereto;
34           (4) any substance designated in subsection (g) of K.S.A. 65-4105, and
35       amendments thereto, and designated in subsection (c), (d), (e), (f) or (g)
36       of K.S.A. 65-4111, and amendments thereto; or
37           (5) any anabolic steroids as defined in subsection (f) of K.S.A. 65-
38       4109, and amendments thereto.
39           Except as provided in subsection (b), any person who violates this sub-
40       section shall be guilty of a drug severity level 3 felony.
41           (b) Notwithstanding any other provision of law, upon conviction of
42       any person pursuant to subsection (a) for an offense in which the sub-
43       stances involved were possessed with intent to sell, sold or offered for

  1       sale in or on, or within 1,000 feet of any school property upon which is
  2       located a structure used by a unified school district or an accredited non-
  3       public school for student instruction or attendance or extracurricular ac-
  4       tivities of pupils enrolled in kindergarten or any of the grades one through
  5       12 and such person is 18 or more years of age, such person shall be guilty
  6       of a drug severity level 2 felony.
  7           Nothing in this subsection shall be construed as requiring that school
  8       be in session or that classes are actually being held at the time of the
  9       offense or that children must be present within the structure or on the
10       property during the time of any alleged criminal act. If the structure or
11       property meets the description above, the actual use of that structure or
12       property at the time alleged shall not be a defense to the crime charged
13       or the sentence imposed.
14           (c) It shall not be a defense to charges arising under this section that
15       the defendant was acting in an agency relationship on behalf of any other
16       party in a transaction involving a controlled substance.
17           (d) For purposes of the uniform controlled substances act, the pro-
18       hibitions contained in this section shall apply to controlled substance an-
19       alogs as defined in subsection (bb) of K.S.A. 65-4101 and amendments
20       thereto.
21           (e) The provisions of this section shall be part of and supplemental
22       to the uniform controlled substances act.
23           Sec. 7. K.S.A. 1997 Supp. 65-4111, 65-4113, 65-4160, 65-4161, 65-
24       4162 and 65-4163 are hereby repealed.
25           Sec. 8. This act shall take effect and be in force from and after its
26       publication in the statute book.
