AN ACT concerning the resetting of cornerstones;
amending K.S.A. 19-
11 1432 and repealing the
existing section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section 1. K.S.A.
19-1432 is hereby amended to read as follows:
15 19-1432. The surveyor shall upon
receipt of such notice, without unnec-
16 essary delay, Upon
receipt of notice pursuant to K.S.A.
19-1432 19-1430,
17 and amendments thereto, that a
cornerstone or monument projects above
18 the usual grade of a roadbed, the
surveyor shall notify the governing body
19 having jurisdiction over such road. The
governing body for township
20 roads shall be the township board. The
governing body of county roads
21 shall be the board of county
commissioners. The governing body of state
22 and federal roads shall be the
state highway commission Kansas
de-
23 partment of
transportation. If the appropriate governing body
deter-
24 mines the cornerstone or monument needs
to be reset, the surveyor shall
25 proceed to reset such cornerstone or
monument and set at least two (2)
26 witness monuments, in a manner calculated
to permanently preserve and
27 mark the proper location of
said the cornerstone or monument,
and. The
28 surveyor shall record such
proceedings, together with a substantial de-
29 scription of the cornerstone or monument,
and the witness monuments,
30 with distances and courses to same, in the
manner provided by the law
31 of permanent surveys. It shall not
be necessary to notify any interested
32 parties. If the
governing body determines a cornerstone or monument
33 which projects above the usual grade
of a roadbed needs to be reset,
34 the cost of resetting cornerstones or
monuments on township roads shall
35 be paid from township road funds, on county
roads from county road
36 funds, state and federal roads from the
state highway fund; and. The cost
37 of resetting cornerstones or
monuments on property of persons, firms or
38 corporations the costs shall be paid by the
parties for whom the service
39 is performed.
40 Nothing in this section shall
be construed as prohibiting the re-
41 setting of cornerstones or monuments
by any land surveyor during
42 the course of a survey paid for by
the landowner requesting such
43 survey.

Sec. 2. K.S.A. 19-1432 is hereby repealed.
2 Sec. 3. This
act shall take effect and be in force from and after its
3 publication in the statute book.
