AN ACT concerning the Kansas public employees
retirement system;
10 relating to parole
officers; amending K.S.A. 74-4914a and repealing
11 the existing
section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section 1. K.S.A. 74-4914a is
hereby amended to read as follows: 74-
15 4914a. (1) As used in K.S.A. 74-4914a to
74-4914e, inclusive, and amend-
16 ments thereto, ``security officer'' means
any person, as certified to the
17 board by the secretary of corrections, who
is employed on or after the
18 effective date of this act as an employee
of the department of corrections:
19 (a) Who is in any position in
a job class in the corrections officer class
20 series including but not limited to
corrections officer I, corrections officer
21 II, corrections supervisor I, corrections
supervisor II and corrections su-
22 pervisor III, or in a
position in the corrections counselor I, corrections
23 counselor II, unit team supervisor or
corrections classification adminis-
24 trator job class or in any position in a
job class in the parole officer class
25 series, including, but not limited to,
parole officer I, parole officer II and
26 parole supervisor, as all such job
classes are described on the effective
27 date of this act in the state job
classification plan in effect for the classified
28 service under the Kansas civil service act
or who is in a position in any
29 successor job class or classes that have
been approved under K.S.A. 75-
30 2938, and amendments
thereto, and that have substantially the same du-
31 ties and responsibilities thereof;
32 (b) who is promoted prior to
or on or after the effective date of this
33 act from a position in any job class under
paragraph (a) to any position in
34 any job class of warden or deputy warden of
any correctional institution,
35 the job class of work release supervisor,
the job class of training officer,
36 correctional institutions,
or the job class of corrections administrator
--
37 security specialist, parole director or
parole hearing officer as such job
38 classes are described on the effective date
of this act in the state job
39 classification plan in effect for the
classified service under the Kansas civil
40 service act or to any successor job class
or classes that are approved under
41 K.S.A. 75-2938, and
amendments thereto, and that have substantially the
42 same duties and responsibilities, if the
person was employed and had at
43 least three consecutive years of service in
any one or more positions in

1 any one or more job classes described
in paragraph (a) immediately pre-
2 ceding promotion to the position in a
job class under this paragraph (b);
3 (c) who is in any
position for which the duties and responsibilities
4 directly and primarily involve
operation of power plant facilities within
5 any correctional institution and
involve regular contact with inmates;
6 (d) who is in any
position for which the duties and responsibilities
7 directly and primarily involve the
operation of the correctional industries
8 activity of the department of
corrections within a correctional institution
9 and involve regular contact with
inmates;
10 (e) who is in any position
for which the duties and responsibilities
11 directly and primarily involve supervision
of food service operations
12 within any correctional institution and
involve regular contact with in-
13 mates; or
14 (f) who is in any position
for which the duties and responsibilities
15 directly and primarily involve supervision
of maintenance operations
16 within any correctional institution and
involve regular contact with in-
17 mates.
18 (2) As used in K.S.A.
74-4914a to 74-4914e, inclusive, and amend-
19 ments thereto, references to the department
of corrections include cor-
20 rectional institutions as defined by K.S.A.
75-5202 and amendments
21 thereto unless the context requires
otherwise.
22 (3) The words and phrases
used in K.S.A. 74-4914a to 74-4914e, in-
23 clusive, and amendments thereto, shall have
the meanings ascribed
24 thereto in K.S.A. 74-4902,
and amendments thereto, unless a different
25 meaning is plainly required by the
context.
26 Sec. 2. K.S.A. 74-4914a is
hereby repealed.
27 Sec. 3. This act shall take
effect and be in force from and after its
28 publication in the statute book.
