AN ACT concerning governmental ethics;
relating to certain violations;
10 relating to liability
for violations by another person.

12 Be it enacted by the Legislature of the
State of Kansas:
13 Section 1. K.S.A. 46-215
through 46-293, and amendments thereto,
14 and K.S.A. 1997 Supp. 46-237a and section 2
shall be known and may be
15 cited as the state governmental ethics
law.
16 Sec. 2. (a) A person is
responsible for a violation of K.S.A. 46-215
17 through 46-286, and amendments thereto, by
another if such person in-
18 tentionally aids, abets, advises, hires,
counsels or procures the other to
19 commit the violation.
20 (b) A person responsible
under subsection (a) also is responsible for
21 any other violation of K.S.A. 46-215
through 46-286, and amendments
22 thereto, committed in pursuance of the
intended violation if the violation
23 reasonably is foreseeable by such person as
a probable consequence of
24 committing or attempting to commit the
violation intended.
25 (c) A person responsible
under this section may be charged with and
26 found to have violated any section of
K.S.A. 46-215 through 46-286, and
27 amendments thereto, although the person
alleged to have directly com-
28 mitted the violation lacked criminal or
legal capacity or has not been
29 found to have violated any provision of
K.S.A. 46-215 through 46-286,
30 and amendments thereto.
31 (d) Any person found
responsible under this section shall be subject
32 to the same penalty, fine, forfeiture or
prosecution as for the underlying
33 violation.
34 (e) The provisions of this
section shall be subject to interpretation
35 and enforcement by the Kansas commission on
governmental standards
36 and conduct in the manner provided by
K.S.A. 46-253 through 46-263,
37 and amendments thereto.
38 Sec. 3. This act shall take
effect and be in force from and after its
39 publication in the statute book.
