                    SENATE BILL No. 452           By Committee on Elections and Local Government           1-16             9             AN ACT concerning elections; relating to campaign finance; relating to
10             violations thereof; amending K.S.A. 25-4142 and repealing the existing
11             section.

13       Be it enacted by the Legislature of the State of Kansas:
14           Section 1. K.S.A. 25-4142 is hereby amended to read as follows:
15       25-4142. K.S.A. 25-4142 to 25-4179, inclusive, and amendments thereto
16       and 25-4119e, 25-4119f, 25-4119g, 25-4148a, 25-4153a, 25-4157a, 25-
17       4169a, 25-4180 to 25-4185, inclusive, and amendments thereto, and
18       K.S.A. 1997 Supp. 25-4186 and section 2, and amendments thereto, shall
19       constitute and may be cited as the ``campaign finance act.''
20           New Sec. 2. (a) A conspiracy is an agreement with another person
21       or persons to commit a violation of the campaign finance act or assist in
22       committing a violation of the campaign finance act. Conspiracy under this
23       section requires that an overt act in furtherance of such conspiracy be
24       committed by the person or by a co-conspirator.
25           (b) It shall be a defense to an allegation of conspiracy that the accused
26       person voluntarily and in good faith withdrew from the conspiracy, and
27       communicated the fact of such withdrawal to one or more of the accused
28       person's alleged co-conspirators, before any overt act in furtherance of
29       the conspiracy was committed.
30           (c) A conspiracy to violate the campaign finance act is a class A mis-
31       demeanor.
32           (d) This section shall be part of and supplemental to the campaign
33       finance act.
34           Sec. 3. K.S.A. 25-4142 is hereby repealed.
35           Sec. 4. This act shall take effect and be in force from and after its
36       publication in the statute book.
