            9             AN ACT concerning special education services for uniquely different ex-
10             ceptional children; relating to determination of grants of state moneys
11             for provision by school districts; amending K.S.A. 1997 Supp. 72-983
12             and repealing the existing section.

14       Be it enacted by the Legislature of the State of Kansas:
15           Section 1. K.S.A. 1997 Supp. 72-983 is hereby amended to read as
16       follows: 72-983. (a) In each school year, ;c/ommencing with the 1994-95
17       school year, to the extent that appropriations are available, each school
18       district which has provided special education services for an exceptional
19       child who uniquely or so severely differs from other exceptional children
20       in physical, mental, social, emotional or educational characteristics that
21       the costs attributable to the provision of special education services for the
22       child are in excess of $25,000 $17,500 for the school year is eligible to
23       receive a grant of state moneys in an amount equal to 75% of that portion
24       of the costs, incurred by the district in the provision of special education
25       services for the child, that is in excess of $25,000 $17,500.
26           (b) In order to be eligible for a grant of state moneys provided for by
27       subsection (a), a school district shall submit to the state board of education
28       an application for a grant and a description of the special education serv-
29       ices provided and the child or children for whom provided. The appli-
30       cation and description shall be prepared in such form and manner as the
31       state board shall require and shall be submitted at a time to be deter-
32       mined and specified by the state board. Approval by the state board of
33       applications for grants of state moneys is prerequisite to the award of
34       grants.
35           (c) Each school district which is awarded a grant under this section
36       shall make such periodic and special reports of statistical and financial
37       information to the state board as it may request.
38           (d) All moneys received by a school district under authority of this
39       section shall be deposited in the special education fund of the school
40       district. Amounts received under this section and deposited in the special
41       education fund shall be used exclusively to reimburse the school district,
42       in part, for the excessive amount expended in providing special education
43       services for uniquely or severely different exceptional children.

  1           (e) The state board of education shall:
  2           (1) Prescribe and adopt criteria for identification of uniquely or se-
  3       verely different exceptional children and for determination of excessive
  4       costs attributable to the provision of special education services for such
  5       children;
  6           (2) approve applications of school districts for grants;
  7           (3) determine the amount of grants and be responsible for payment
  8       of such grants to school districts; and
  9           (4) prescribe all forms necessary for reporting under this section.
10           (f) If the amount of appropriations for the payment of grants under
11       this section is insufficient to pay in full the amount each school district is
12       determined to be eligible to receive for the school year, the state board
13       shall prorate the amount appropriated among all school districts which
14       are eligible to receive grants of state moneys in proportion to the amount
15       each school district is determined to be eligible to receive.
16           Sec. 2. K.S.A. 1997 Supp. 72-983 is hereby repealed.
17           Sec. 3. This act shall take effect and be in force from and after its
18       publication in the statute book.
