      A RESOLUTION memorializing Congress to revise
certain laws which
10             prohibit a disabled
military veteran from receiving both full retirement
11             pay and disability
compensation benefits.
12             
13           WHEREAS, Under a federal
law that dates back to the 19th century,
14       military veterans are denied concurrent
dual receipt of full retirement
15       pay and disability compensation benefits;
and
16           WHEREAS, Military
veterans are instead allowed only to receive re-
17       tirement pay or disability compensation
benefits or must waive an amount
18       of retirement pay equal to the amount of
disability compensation benefits;
19       and
20           WHEREAS, In contrast,
federal civilian employees are not subject to
21       such a deduction of disability compensation
benefits; and
22           WHEREAS, A disabled
veteran who has held a nonmilitary federal
23       job for the requisite durational period
required for retirement receives
24       full longevity retirement pay, undiminished
by the subtraction of disability
25       compensation benefits: Now,
therefore,
26           Be it resolved by the
House of Representatives of the State of Kan-
27       sas: That we do hereby
memorialize Congress to change those laws
28       which prohibit a disabled military veteran
from receiving both full retire-
29       ment pay and disability compensation
benefits; and
30           Be it further
resolved: That the Chief Clerk of the House of Repre-
31       sentatives be directed to send enrolled
copies of this resolution to each
32       member of the Kansas Congressional
Delegation.
