            9             AN ACT relating to the department of social and rehabilitation services;
10             concerning sale, conveyance and leasing of certain real property.
11            
12       Be it enacted by the Legislature of the State of Kansas:
13           Section 1. (a) The secretary of social and rehabilitation services is
14       hereby authorized to sell and convey on behalf of the state of Kansas in
15       the manner provided by this act the following described real estate: The
16       southwest Quarter of Section 24; Township 22, Range 13 in Stafford
17       County, Kansas. The above described property being that which was
18       willed to the state of Kansas by Otto Hitz following the life estate created
19       for Delmar Lee Hitz.
20           (b) When the real estate described in subsection (a) is sold, the pro-
21       ceeds thereof, after deduction of the expenses of such sale and the cost
22       of the survey and the appraisal of the real estate, shall be deposited in
23       the state treasury to the credit of the Winfield properties special revenue
24       fund.
25           Sec. 2. (a) The secretary of social and rehabilitation services is
26       hereby authorized to sell and convey on behalf of the state of Kansas in
27       the manner provided by this act the following described real estate: A
28       part of Section 3, Township 15, Range 3; however, the city has approved
29       a preliminary plat in which the subject property will be legally described
30       as, ``Lots 15, 16, 17, and 18, in Block 12, Schilling Subdivision No. 5, City
31       of Salina, Saline County, Kansas.''
32           (b) When the real estate described in subsection (a) is sold, the pro-
33       ceeds thereof, after deduction of the expenses of such sale and the cost
34       of the survey and the appraisal of the real estate, shall be deposited in
35       the state treasury to the credit of the social welfare fund.
36           Sec. 3. (a) Before any property shall be sold under the provisions of
37       this act, the real estate described in sections 1 and 2 shall be appraised
38       by three disinterested appraisers who shall be appointed as provided in
39       K.S.A. 75-3043a, and amendments thereto. Such appraisals shall be in
40       writing and filed with the secretary of social and rehabilitation services,
41       and the cost of the appraisals may be paid from the proceeds of the sales.
42       Upon the filing of such appraisals, the secretary of social and rehabilita-
43       tion services shall advertise for public auction or sealed bids on the real

  1       estate described in sections 1 and 2 for not less than three consecutive
  2       weeks by publication in the Kansas register. Subject to the approval of
  3       the governor, such sales shall be made to the highest responsible bidder
  4       whose bid is submitted within 30 days after the last publication of such
  5       notice. The secretary of social and rehabilitation services or the governor
  6       may reject any and all bids, and in case all bids are rejected, bids may be
  7       called for again as in the first instance. Each bid shall be accompanied by
  8       a certified check in the amount of 5% of such bid which sum shall be
  9       forfeited in case of default by any bidder whose bid is accepted.
10           (b) Upon acceptance of any such bid, a deed conveying such real
11       estate shall be executed and duly acknowledged by the secretary before
12       an officer authorized by law to take acknowledgments. Such deed shall
13       contain a recital of all proceedings in compliance with this act, and such
14       recital shall be prima facie evidence that the proceedings were had in the
15       manner and form recited. Such deed shall be approved as to form by the
16       attorney general.
17           Sec. 4. Notwithstanding any of the provisions contained in subsec-
18       tion (d) of K.S.A. 1997 Supp. 39-708c, and amendments thereto, the
19       secretary of social and rehabilitation services may lease office or business
20       space for a period exceeding 10 years if the proposed lease has been
21       presented to the joint committee on state building construction for advice
22       and consultation.
23           Sec. 5. This act shall take effect and be in force from and after its
24       publication in the Kansas register.
