AN ACT concerning elections; establishing a
bipartisan commission on
11 campaign
practices.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section 1. This act
shall be known and may be cited as the bipartisan
15 campaign commission act.
16 Sec. 2. As used in
this act, ``commission'' means the bipartisan com-
17 mission on campaign practices.
18 Sec. 3. (a) The
commission shall be composed of nine persons to be
19 appointed as follows:
20 (1) Two members shall be
appointed by the executive director
board
21 of directors of the Kansas
state association of society of
association
22 executives.
23 (2) Two members shall be
appointed by the Kansas A.F.L.-C.I.O.
24 (3) Two members shall be
appointed by the board of directors of the
25 Kansas Chamber of Commerce and
Industry.
26 (4) Two members shall be
appointed by the commission on govern-
27 mental standards and conduct. Such members
shall be at large members
28 representing the interest of the voters of
Kansas.
29 (5) One member shall be
appointed by the state board of education
30 and shall represent education.
31 The members described in
paragraphs (1) through (5) shall be ap-
32 pointed within 30 days after the effective
date of this act. No more than
33 five members of the commission shall be
from the same political party.
34 No person who is an elected state, city or
county officer shall be appointed
35 to the commission, whether such person was
elected or appointed to such
36 office.
37 (b) The executive
director of the Kansas commission on govern-
38 mental standards and conduct shall serve as
the temporary chairperson
39 of the commission. The temporary
chairperson shall call the first meeting
40 of the commission within 30 days following
the appointment of all mem-
41 bers to the commission. At the first
meeting, the commission shall meet
42 and organize by the election of a
chairperson and vice-chairperson and
43 other officers deemed necessary. The
commission may adopt rules gov-

1 erning the conduct of its
meetings.
2 (c) The commission
shall meet at the call of the chairperson or at the
3 request of six members of the
commission.
4 (d) Vacancies in
the commission shall be filled in the same manner
5 as the original appointment was
made.
6 (e) Members of the
commission shall be paid compensation, subsis-
7 tence allowances, mileage and other
expenses as provided by K.S.A. 75-
8 3223, and amendments thereto.
9 (f) Six members of
the commission shall constitute a quorum. Any
10 decision of the commission shall require
the affirmative vote of six mem-
11 bers.
12 (g) The staff of the
office of the revisor of statutes, the legislative
13 research department and the division of
legislative administrative services
14 shall provide such assistance as may be
requested by the commission and
15 authorized by the legislative coordinating
council. The legislative division
16 of post audit shall provide such assistance
as may be requested by the
17 commission and authorized by the
legislative post audit committee. The
18 Kansas commission on governmental standards
and conduct and each
19 other state agency shall provide assistance
to the commission as may be
20 requested by the commission.
21 Sec. 4. The
commission shall study the laws and any rules and reg-
22 ulations that affect how campaigns for
state office are conducted and may
23 make recommendations for legislation. In
studying state campaign prac-
24 tices, the commission shall consider:
25 (1) Whether too much or
too little money is spent trying to influence
26 campaigns for state office and whether the
money spent is sufficiently
27 disclosed.
28 (2) Whether the current
laws and rules and regulations governing
29 campaigns for state office encourage or
discourage those most qualified
30 to hold office from seeking political
office.
31 (3) Whether the existing
system of financing campaigns for state of-
32 fice promotes trust and confidence in the
political process among the
33 electorate.
34 (4) Whether the rules
governing access to media ensure that the elec-
35 torate has the greatest possible
opportunity to be informed of candidates'
36 positions on the issues.
37 (5) Any other matters
the commission considers appropriate.
38 Sec. 5. (a) On or
before February 2, 1999, the commission shall sub-
39 mit a report of its findings and
recommendations to the governor and the
40 legislature. Such report may include any
recommendation for changes in
41 the laws and any rules and regulations
governing the conduct of state
42 campaigns. Recommendations to the
legislature shall be in drafted bill
43 form together with any explanatory
information and data the commission

1 deems advisable.
2 (b) Bills
introduced at the recommendation of the commission shall
3 receive expedited consideration by
the legislature. The bills shall be in-
4 troduced in the house upon submission
of the report. The bills shall be
5 referred to the committee of the
whole under the order of general orders.
6 The speaker shall bring the bills to
the top of the calendar no more than
7 10 days after introduction. The bills
shall be subject to debate and roll
8 call vote. The joint rules of the
house and senate concerning amendments
9 shall be suspended for the purposes
of debating and roll call voting on
10 such bills. No amendments shall be allowed.
If any such bill receives a
11 constitutional majority vote in the house,
the bills shall be introduced to
12 the senate and referred to the senate
committee of the whole under the
13 order of general orders. Such bills shall
be brought to the top of the senate
14 calendar no more than 10 days after
introduction in the senate. The bills
15 shall be subject to debate and roll call
vote. The joint rules of the house
16 and senate shall be suspended for the
purposes of debating and roll call
17 voting on any such bill. No amendments
shall be allowed.
18 Sec. 6. The
commission shall cease to exist May 8, 1999.
19 Sec. 7. This act
shall take effect and be in force from and after its
20 publication in the Kansas register.
