            9             AN ACT enacting the selective service registration awareness and com-
10             pliance act.
11            
12                 WHEREAS, The legislature finds 50 U.S.C. 451 et seq. (military se-
13             lective service act) requires all male citizens and every other male person
14             residing in the United States except for lawfully admitted non-immigrant
15             aliens upon reaching their eighteenth birthday to register with the selec-
16             tive service system; and
17                 WHEREAS, The legislature further finds that federal statutes limit
18             eligibility for federal student financial assistance and eligibility for em-
19             ployment within the executive branch of the federal government to per-
20             sons who are in compliance with the requirements of the military selective
21             service act.

23             Be it enacted by the Legislature of the State of Kansas:
24                 Section 1. A male person may not enroll in a state-supported insti-
25             tution of postsecondary education unless he is in compliance with the
26             military selective service act, 50 U.S.C. 451 et seq.
27                 Sec. 2. A male person may not receive a loan, grant, scholarship or
28             other financial assistance for postsecondary education funded by state
29             revenue, including federal funds or gifts and grants accepted by this state,
30             or receive a student loan guaranteed by the state unless he is in compli-
31             ance with the military selective service act, 50 U.S.C. 451 et seq.
32                 Sec. 3. No male person who has attained the age of 18 years who
33             fails to be in compliance with the military selective service act, 50 U.S.C.
34             451 et seq. shall be eligible for employment by or service for the state, or
35             a political subdivision of the state, including all boards and commissions,
36             departments, agencies, institutions and instrumentalities.
37                 Sec. 4. It shall be the duty of all officials having charge of and au-
38             thority over the hiring of employees by the state or political subdivisions,
39             and over state-supported institutions of postsecondary education, and
40             over the granting of state-supported financial assistance for postsecondary
41             education as described in this act to assure themselves that applicants are
42             in compliance with the military selective service act, 50 U.S.C. 451 et seq.
43                 Sec. 5. A person may not be denied a right, privilege or benefit under

  1             this act by reason of failure to present himself for and submit to the
  2             requirement to register pursuant to the military selective service act, 50
  3             U.S.C. 451 et seq., if:
  4                 (a) The requirement for the person to so register has terminated or
  5             become inapplicable to the person; and
  6                 (b) the person is or has already served in the armed forces or has a
  7             condition that would preclude acceptability for military service.
  8                 Sec. 6. If any provision of this act or the application thereof to any
  9             person or circumstance is held invalid, the invalidity does not affect other
10             provisions or applications of the act which can be given effect without
11             the invalid provision or application, and to this end the provisions of this
12             act are severable.
13                 Sec. 7. This act shall take effect and be in force from and after its
14             publication in the statute book.
