                    HOUSE BILL No. 2960           By Committee on Federal and State Affairs           2-13             9             AN ACT concerning district court judges; amending K.S.A. 1997 Supp.
10             46-234 and repealing the existing section.

12       Be it enacted by the Legislature of the State of Kansas:
13           New Section 1. (a) There is hereby created in the third judicial dis-
14       trict two additional district judge positions hereby designated as division
15       15 and 16. The additional district judges shall be selected and take office
16       in the manner prescribed by subsection (b) of K.S.A. 20-2913, and
17       amendments thereto.
18           (b) Any additional district judge position created by this section shall
19       be considered a position created by the supreme court and not a civil
20       appointment to a state office pursuant to K.S.A. 46-234, and amendments
21       thereto.
22           Sec. 2. K.S.A. 1997 Supp. 46-234 is hereby amended to read as fol-
23       lows: 46-234. No elected state officer shall within one year after the ex-
24       piration of such officer's last term receive any civil appointment to a state
25       office which was created by law during the last term for which such person
26       had been elected, and all such appointments shall be void. Upon resig-
27       nation by an elected state officer, such person may be appointed to any
28       elective state office to fill a vacancy. As used in this section, the term ``civil
29       appointment to a state office'' shall not include an additional district judge
30       position created by section 1 or K.S.A. 20-355, and amendments thereto.
31           Sec. 3. K.S.A. 1997 Supp. 46-234 is hereby repealed.
32           Sec. 4. This act shall take effect and be in force from and after its
33       publication in the statute book.
