                    HOUSE BILL No. 2954           By Representative Tomlinson           2-13             9             AN ACT concerning criminal procedure; relating to a search without a
10             search warrant; amending K.S.A. 22-2501 and repealing the existing
11             section.

13       Be it enacted by the Legislature of the State of Kansas:
14           Section 1. K.S.A. 22-2501 is hereby amended to read as follows:
15       22-2501. When a lawful arrest is effected a law enforcement officer may
16       reasonably search the person arrested and the area within such person's
17       immediate presence for the purpose of
18           (a) Protecting the officer from attack;
19           (b) Preventing the person from escaping; or
20           (c) Discovering the fruits, instrumentalities, or evidence of   (tri-stars)e any
21       crime.
22           Sec. 2. K.S.A. 22-2501 is hereby repealed.
23           Sec. 3. This act shall take effect and be in force from and after its
24       publication in the statute book.
