AN ACT concerning the retirement system for
judges; relating to pur-
10 chase of service
credit; amending K.S.A. 20-2606 and repealing the
11 existing section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section 1. K.S.A.
20-2606 is hereby amended to read as follows:
15 20-2606. (a) Any judge whose service is
terminated prior to retirement,
16 for any cause other than death, may, upon
written request to the board,
17 have returned the total amount of
accumulated contributions which the
18 judge has made to the fund after the
retirement system for judges has a
19 reasonable time to process the application
for withdrawal. The return of
20 accumulated contributions to a judge shall
preclude that judge from any
21 benefits under the retirement system for
judges unless and until that
22 judge again serves in such capacity.
23 (b) Any incumbent judge
over 70 years of age with a total service of
24 at least eight years at the time the
judge's present term of office expires,
25 or at the time of retirement if the judge
retires before the end of the
26 judge's present term, shall receive
retirement annuities as provided in
27 K.S.A. 20-2608, 20-2609 and 20-2610, and
any amendments thereto, un-
28 less the judge requests the return of
accumulated contributions under
29 this section.
30 (c) In case any judge,
who has had such judge's accumulated contri-
31 butions returned under this section, serves
again in such capacity, such
32 judge may return the amount refunded under
this section without interest
33 or penalty and regain such judge's original
status under the retirement
34 system for judges.
35 (d) Any member of the
retirement system for judges who was pre-
36 viously a member of the Kansas public
employees retirement system or
37 the Kansas police and firemen's retirement
system and who forfeited
38 service credit under either of those
systems by reason of termination of
39 employment and withdrawal of their
contributions to that system, may
40 elect to purchase service credit for the
previously forfeited service credit
41 by means of having employee
contributions as provided in K.S.A. 20-2603
42 and amendments thereto deducted from
such judge's compensation at an
43 additional rate of contribution, based
upon such judge's attained age at

1 the time of purchase and using
actuarial assumptions and tables in use
2 by the retirement system at such
time of purchase for such periods of
3 service. Such additional rate of
contribution shall commence at the begin-
4 ning of the quarter following such
election and shall remain in effect until
5 all of the full quarters of such
service have been purchased. Such member
6 may purchase such service by means
of a single lump-sum payment
and
7 in lieu of employee contributions
as provided in this subsection. Such
8 service shall be recredited to that
system. The amount of the lump-sum
9 payment shall be determined by the
actuary using the member's then
10 current annual rate of compensation
and, the actuarial assumptions
and
11 tables then currently in use by that
retirement system and the judge's
12 attained age.
13 Sec. 2. K.S.A.
20-2606 is hereby repealed.
14 Sec. 3. This act
shall take effect and be in force from and after its
15 publication in the statute book.
