            9             AN ACT regulating traffic; concerning weight limitations; amending
10             K.S.A. 8-1909 and repealing the existing section.

12       Be it enacted by the Legislature of the State of Kansas:
13           Section 1. K.S.A. 8-1909 is hereby amended to read as follows: 8-
14       1909. (a) Except as provided in paragraph (4) of this subsection, no ve-
15       hicle or combination of vehicles shall be moved or operated on any high-
16       way when the gross weight on two or more consecutive axles exceeds the
17       limitations prescribed in the following table:

39       except that two consecutive sets of tandem axles may carry a gross load of 34,000 pounds
40       each if the overall distance between the first and last axles is 36 feet or more.
41           (1) Except as provided in paragraph (4) of this subsection, the gross
42       weight on any one axle of a vehicle shall not exceed the limits prescribed
43       in K.S.A. 8-1908, and amendments thereto.

  1           (2) For vehicles and combinations of vehicles on the interstate system
  2       the table in this section shall not authorize a maximum gross weight of
  3       more than 80,000 pounds.
  4           (3) The table in this section shall not apply to truck tractor and dump
  5       semitrailer or truck trailer combination when such are used as a combi-
  6       nation unit exclusively for the transportation of sand, salt for highway
  7       maintenance operations, gravel, slag stone, limestone, crushed stone, cin-
  8       ders, coal, blacktop, dirt or fill material, when such vehicles are used for
  9       transportation to a construction site, highway maintenance or construc-
10       tion project or other storage facility, except that such vehicles or combi-
11       nation of vehicles shall not be exempted from any application of the table
12       as may be required to determine applicable axle weights for triple and
13       quad axles as defined in K.S.A. 8-1908, and amendments thereto. As used
14       in this subpart (3), the term ``dump semitrailer'' means any semitrailer
15       designed in such a way as to divest itself of the load carried thereon.
16           (4) In the case of a vehicle or combination of vehicles exclusively
17       transporting milk from the point of production to the primary market and
18       the return of dairy supplies and dairy products from such primary market
19       to the farm, the gross weight imposed on any one axle may not exceed
20       21,000 pounds or, for two axles eight or less feet apart, 37,000 pounds or,
21       for groups of three or more consecutive axles more than nine feet apart,
22       a weight of 2,000 pounds more than is shown in the table in this section.
23       This paragraph does not apply to the national system of interstate and
24       defense highways.
25           (b) Any vehicle registered under the laws of this state which vehicle
26       is designed and used primarily for the transportation of property or for
27       the transportation of 10 or more persons may, at the time of its registra-
28       tion, be subjected by the director of vehicles to investigation or test as
29       may be necessary to enable such director to determine whether such
30       vehicle may safely be operated upon the highways in compliance with all
31       provisions of this act. Every such vehicle shall meet the following require-
32       ments:
33           (1) It shall be equipped with brakes as required in K.S.A. 8-1734, and
34       amendments thereto.
35           (2) Every motor vehicle to be operated outside of business and res-
36       idence districts shall have motive power adequate to propel such vehicle
37       and any load thereon or to be drawn thereby, at a speed which will not
38       impede or block the normal and reasonable movement of traffic. Excep-
39       tion to this requirement shall be recognized when reduced speed is nec-
40       essary for safe operation or when a vehicle or combination of vehicles is
41       necessarily or in compliance with law or police direction proceeding at
42       reduced speed.
43           (c) It shall be unlawful for any person to operate any vehicle or com-

  1       bination of vehicles with a gross weight in excess of the limitations set
  2       forth in article 19 of chapter 8 of Kansas Statutes Annotated, except as
  3       provided in K.S.A. 8-1911, and amendments thereto.
  4           (d) As used in this section, ``interstate system'' means the national
  5       system of interstate and defense highways.
  6           Sec. 2. K.S.A. 8-1909 is hereby repealed.
  7           Sec. 3. This act shall take effect and be in force from and after its
  8       publication in the statute book.
