AN ACT concerning civil procedure; relating to
exemptions; amending
11 K.S.A. 60-2304 and
repealing the existing section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 New Section 1. Any
employer as defined by K.S.A 44-703 and
15 amendments thereto, shall inform every
newly hired employee that pur-
16 suant to the federal bankruptcy laws, an
employer is only required to pay
17 an employee for 90 days of back pay, of not
more than $4,000 for such
18 back wages, if such employer files for
bankruptcy. Such notification shall
19 be in writing.
20 New Sec. 2. Any
person in the state of Kansas who files bankruptcy
21 and utilizes the exemptions pursuant to
article 23 of chapter 60 of the
22 Kansas Statutes Annotated, and amendments
thereto shall be required to
23 hire at such person's own expense, a
certified public accountant to annual
24 audit such person's finances for seven
years following the filing of such
25 bankruptcy. A copy of such audit shall be
filed with the bankruptcy courts.
26 Sec. 3. K.S.A.
60-2304 is hereby amended to read as follows: 60-
27 2304. Every person residing in this state
shall have exempt from seizure
28 and sale upon any attachment, execution or
other process issued from
29 any court in this state, the following
articles of personal property:
30 (a) The furnishings,
equipment and supplies, including food, fuel and
31 clothing, for the person which is in the
person's present possession and
32 is reasonably necessary at the principal
residence of the person for a
33 period of one year.
34 (b) Ornaments of the
debtor's person, including jewelry, having a
35 value of not to exceed $1,000.
36 (c) Such person's
interest, not to exceed $20,000
$6,000 in value, in
37 one means of conveyance regularly used for
the transportation of the
38 person or for transportation to and from
the person's regular place of
39 work, except that the value limitation
specified in this subsection shall
40 not apply when the means of conveyance is a
vehicle designed or
41 equipped, or both, for handicapped persons,
as defined in K.S.A. 8-1,124
42 and amendments thereto.
43 (d) A burial plot or
crypt or any cemetery lot exempt from process

1 pursuant to K.S.A. 17-1302 and
amendments thereto.
2 (e) The books,
documents, furniture, instruments, tools, implements
3 and equipment, the breeding stock,
seed grain or growing plants stock,
4 or the other tangible means of
production regularly and reasonably nec-
5 essary in carrying on the person's
profession, trade, business or occupa-
6 tion in an aggregate value not to
exceed $7,500.
7 (f) Any personal
property exempt from process pursuant to K.S.A.
8 36-202, 48-245 or 84-2-326, and
amendments thereto.

Sec. 4. K.S.A. 60-2304 is hereby repealed.
10 Sec. 5. This act
shall take effect and be in force from and after its
11 publication in the statute book.
