AN ACT concerning the Kansas river; designating
certain reaches to be
13 used for certain
purposes; relating to prosecution for certain
14 crimes[;
relating to certain improvements on the Kansas river].

16 Be it enacted by the Legislature of the
State of Kansas:
17 Section 1. (a) As
used in this section:
18 (1) ``Kansas river
reach'' means all land owned by the state of Kansas
19 in the Kansas river channel up to the
ordinary high water mark within
20 the designated reach. In cases where the
state's ownership interest is
21 affected by avulsion, ownership will be
determined pursuant to K.S.A.
22 82a-201 et seq. and amendments
thereto.
23 (2) ``Multi-use reach''
means a reach of the Kansas river where any
24 use authorized or not prohibited by law is
allowed.
25 (3) ``Recreational use
reach'' means a reach of the Kansas river where
26 any use is allowed that is allowed
in a multi-use reach except sand and
27 gravel dredging activities that
require a permit pursuant to K.S.A. 82a-
28 301 et seq.
and amendments thereto commercial and industrial
activ-
29 ities that require a permit pursuant to
K.S.A. 82a-301 et seq., and
30 amendments thereto are prohibited except
for public water sup-
31 plies, wastewater and stormwater
outfalls, electric utilities, flood
32 control and drainage works, bridges or
buried transmission lines
33 and pipelines.
34 (4) ``River miles''
means river miles officially designated by the
35 United States army corps of engineers in
the Emergency Flood Plan,
36 Kansas River, Mouth to Junction
City, file number EM-1-420, March
37 1977, revised April, 1986.
38 (b) (1) The
following are hereby designated as multi-use reaches on
39 the Kansas river: River mile 0 to river
mile 51.8 and river mile 72 to river
40 mile 125.
41 (2) The following are
hereby designated as recreational use reaches
42 on the Kansas river: River mile 51.8 to
river mile 72 and river mile 125

1 Sec. 2. Any person
who commits any of the following along the
2 Kansas river shall be subject to
prosecution: Criminal trespass as
3 defined by K.S.A. 21-3721 and
amendments thereto; littering, as
4 defined by K.S.A. 21-3722 and
amendments thereto; injury to a
5 domestic animal, as defined by
K.S.A. 21-3727 and amendments
6 thereto; criminal hunting, as
defined by K.S.A. 21-3728 and
7 amendments thereto; obstructing,
injuring, damaging or destroy-
8 ing property in violation of
K.S.A. 24-636 and amendments
9 thereto; or any other violation of
law.
10 [Sec. 3. Before
causing any public access, boating facilities,
11 ramps or docks to be built on the Kansas
river within or adjacent
12 to any drainage district bounding the
Kansas river, the secretary
13 of wildlife and parks shall obtain
written approval of the proposed
14 project from such district or from the
owner of the property af-
15 fected by the location of such public
access, boating facilities,
16 ramps or docks.]
