            9             AN ACT concerning retail electric service; imposing certain requirements
10             upon implementation of competition in retail sales of generation
11             service.

13       Be it enacted by the Legislature of the State of Kansas:
14           Section 1. (a) As used in this section:
15           (1) ``Renewable resources'' means resources capable of being re-
16       placed by natural ecological cycles or sound management practices and
17       includes but is not limited to wind, solar, hydropower, biomass and landfill
18       gas.
19           (2) ``Retail electric service provider'' means any person or entity sell-
20       ing electric generation service at retail in this state.
21           (b) If competition in retail sales of electric generation service is im-
22       plemented in the state of Kansas, each retail electric service provider
23       participating in such competition shall submit annually to the state cor-
24       poration commission verification, including sufficient reporting to docu-
25       ment compliance, that during the calendar years immediately following
26       implementation of competition, not less than the following percentages
27       of the electricity delivered to the seller's retail customers in this state is
28       generated from renewable resources:
29           (1) In the first year, 2.5%;
30           (2) in the second year, 3.0%;
31           (3) in the third year, 3.5%;
32           (4) in the fourth year, 4.0%;
33           (5) in the fifth year, 4.5%;
34           (6) in the sixth year, 5.0%;
35           (7) in the seventh year, 6.0%;
36           (8) in the eighth year, 7.0%;
37           (9) in the ninth year, 8.0%;
38           (10) in the tenth year, 9.0%;
39           (11) in the eleventh year, 10.0%;
40           (12) in the twelfth year, 11.0%;
41           (13) in the thirteenth year, 12.0%;
42           (14) in the fourteenth year, 13.0%;
43           (15) in the fifteenth year, 14.0%;

  1           (16) in the sixteenth year, 15.0%;
  2           (17) in the seventeenth year, 16.0%;
  3           (18) in the eighteenth year, 17.0%;
  4           (19) in the nineteenth year, 18.0%;
  5           (20) in the twentieth year, 19.0%; and
  6           (21) in the twenty-first and subsequent years, 20%.
  7           (c) The state corporation commission may adopt rules and regulations
  8       governing the form and content of the verification and reports required
  9       by this section.
10           Sec. 2. This act shall take effect and be in force from and after its
11       publication in the statute book.
