AN ACT relating to the Kansas Statutes
Annotated; concerning distri-
10 bution thereof;
amending K.S.A. 77-138, 77-151 and 77-165 and re-
11 pealing the existing
sections.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section 1. K.S.A.
77-138 is hereby amended to read as follows: 77-
15 138. (a) Volumes of the Kansas Statutes
Annotated shall be printed and
16 bound by the director of printing and
delivered to the secretary of state
17 who shall dispose of them as follows:
18 First, the secretary
of state shall deposit in the supreme court law
19 library and in the state library such
number of copies as the state law
20 librarian and the state librarian,
respectively, shall request for use in the
21 law library and the state library, for the
purposes of the publication col-
22 lection and depository system established
under K.S.A. 75-2566 and
23 amendments thereto, and for the purpose of
making exchanges with the
24 various states and territories, and the
secretary of state shall retain one
25 set for the secretary's use in the
secretary's office.
26 Second, (1)(A)
the secretary of state shall distribute two (i)
one com-
27 plete sets set of
the Kansas Statutes Annotated to each member of the
28 legislature for the 1999 regular session
of the legislature, and (ii) there-
29 after, one complete set of the Kansas
Statutes Annotated to each member
30 of the legislature following such
member's election or appointment to such
31 member's first term of office in the
legislature;
32 (B) at each
regular session, one thereafter during such
member's con-
33 tinuous period of service as a member of
the legislature, such member
34 may purchase one additional complete set
at the serving-legislator price
35 of $100; and
36 (C) upon the written
request of a member of the legislature receiving
37 a complete set of the Kansas Statutes
Annotated, or purchasing a complete
38 set at the serving-legislator price,
each such set of which shall have the
39 respective member's
a name printed thereon as specified by the
member.
40 (2) The secretary of
state shall distribute to each former member of
41 the legislature so requesting one copy
of each replacement volume of the
42 Kansas Statutes Annotated distributed in
the first year following the end
43 of such former member's term of
office.

1 (3) The
secretary of state shall distribute such number of complete
2 sets and individual volumes of the
Kansas Statutes Annotated (A) to the
3 office of revisor of statutes as the
revisor of statutes shall request, (B) to
4 the legislative research department
as the director of legislative research
5 shall request, (C) to the division of
post audit as the post auditor shall
6 request, (D) to the division of
legislative administrative services as the
7 director of legislative
administrative services shall request, and (E) to the
8 judicial branch of state government
as the chief justice of the supreme
9 court shall request.
10 (3)
(4) The secretary of state shall distribute: (A) Two
sets to each
11 representative in congress and United
States senator from the state of
12 Kansas, upon request by such representative
or senator; (B) one set each
13 to the governor, lieutenant governor and
attorney general; (C) to Wash-
14 burn university school of law, the number
of sets, not to exceed 60 sets,
15 that the librarian of the school of law
certifies to the secretary of state as
16 necessary for the purpose of exchanging
with other states and territories
17 and to be kept in the library for the use
of faculty and students of the
18 university; (D) to the school of law of the
university of Kansas, the number
19 of sets, not to exceed 60 sets, that the
librarian of the school of law certifies
20 to the secretary of state as necessary for
the purpose of exchanging with
21 other states and territories and to be kept
in the library for the use of
22 faculty and students of the university; (E)
to the clerk of the district court
23 of the United States for the state of
Kansas, the number of sets, not to
24 exceed five sets, as are requested by such
clerk; (F) one set to each county
25 law library in the state, upon request by
the librarian thereof; (G) to each
26 county clerk, the number of sets requested
by the county clerk, not to
27 exceed seven sets, to be distributed not
more than one set each to the
28 county or district attorney, the county
clerk, the county counselor, if any,
29 the register of deeds, the sheriff, the
county treasurer, and the board of
30 county commissioners, which set shall be
retained by the county clerk for
31 use by such board; (H) not more than one
set to each city of the third
32 class, one set to each city of the second
class and two sets to each city of
33 the first class, upon request by the city
clerk; and (I) one set to the state
34 historical society library.
35 Third, the balance of
statute books, after the above distribution shall
36 be kept by the secretary of state for
distribution under subsection (d) or
37 for sale.
38 (b) The secretary of
state shall sell each volume of the Kansas Statutes
39 Annotated, including replacement volumes,
at the per volume price fixed
40 therefor by the legislative coordinating
council under this section. Gen-
41 eral index volumes, when sold separately
and not as a part of a set of
42 cumulative supplements, shall be sold at
the per volume price fixed there-
43 for by the legislative coordinating
council. The secretary of state shall

1 remit all moneys received from such
sales under this section to the state
2 treasurer at least monthly and the
state treasurer shall deposit the entire
3 amount of each such remittance in the
state treasury to the credit of the
4 state general fund.
5 (c) Except as
otherwise provided in this section for the serving-leg-
6 islator price for a complete
set, the legislative coordinating council shall
7 fix the per volume price of each
volume of the Kansas Statutes Annotated,
8 including replacement volumes, sold
under this section to recover the
9 costs of printing and binding such
volumes. The legislative coordinating
10 council shall revise such prices from time
to time for the purposes of
11 covering and recovering such costs.
12 (d) The secretary of
state shall provide, on written request by a mem-
13 ber of the legislature, any volume or
cumulative supplement to a volume
14 of the Kansas Statutes Annotated which
such member requires to replace
15 a volume or supplement which was
distributed to such member or pur-
16 chased by such member as part of a
complete set for the serving-legislator
17 price pursuant to this section, or which
was distributed to such member
18 pursuant to K.S.A. 77-151 or 77-165 and
amendments thereto, and which
19 has been damaged, destroyed or
lost.
20 (e) As used in this
section, ``first term of office in the legislature''
21 means the first term of office of a
person elected or appointed as a member
22 of the legislature who was not serving
as a member of the legislature on
23 the date preceding the date on which
commences the term of office for
24 which such election or appointment is
effective, including any such person
25 who had previously served as a member of
the legislature.
26 Sec. 2. K.S.A.
77-151 is hereby amended to read as follows: 77-151.
27 (a) Each year the revisor of statutes shall
edit and prepare for printing
28 and publication such volumes of the Kansas
Statutes Annotated as have
29 been included in the detailed budget of the
legislative coordinating coun-
30 cil for the revisor of statutes. Except as
otherwise provided by law for
31 volumes containing constitutions and the
general index, the volume or
32 volumes published each year shall contain
all of the statutes in force and
33 effect then contained in the volume or
volumes of the Kansas Statutes
34 Annotated being replaced and the then
current supplements thereto, to-
35 gether with all acts passed by the current
session of the legislature and
36 assigned by the revisor of statutes to
chapters in the volume or volumes
37 being newly published.
38 (b) When more than one
volume is being newly published in any year,
39 the material in the replacement volumes
shall be divided between or
40 among the replacement volumes as nearly
equally as practicable by the
41 revisor of statutes. Each volume shall be
printed and bound by the divi-
42 sion of printing in the format prescribed
by K.S.A. 77-152 and amend-
43 ments thereto. Replacement volumes shall
not contain volume indexes.

1 In editing and preparing the material
to be contained in replacement
2 volumes of the Kansas Statutes
Annotated for publication, the provisions
3 of K.S.A. 77-133, 77-136, 77-136a and
77-152, and amendments to these
4 statutes, shall govern the revisor
and the division of printing, insofar as
5 the same can be made applicable, and
the statutes to be contained in
6 replacement volumes shall be
authenticated in the same manner as re-
7 quired under K.S.A. 77-137 and
amendments thereto. After publication
8 of replacement volumes, each shall
thereafter be kept up to date by cu-
9 mulative supplements in the same
manner as provided for supplemen-
10 tation of Kansas Statutes Annotated by
K.S.A. 77-163 et seq. and amend-
11 ments thereto.
12 (c) Replacement volumes
of the Kansas Statutes Annotated shall be
13 printed in the number of copies specified
by the revisor of statutes, sub-
14 ject to available appropriations, and shall
be distributed and sold in the
15 same manner as provided in K.S.A. 77-138
and amendments thereto as
16 for the distribution of volumes of the
Kansas Statutes Annotated, except
17 that each member of the legislature (1)
shall receive one copy of each
18 replacing volume for the purpose of
updating the complete set of the Kan-
19 sas Statutes Annotated received at the
time of the commencement of their
20 first term of office in the legislature
pursuant to K.S.A. 77-138 and amend-
21 ments thereto, or the complete set
received for the 1999 regular session
22 pursuant to K.S.A. 77-138 and amendments
thereto, and (2) shall receive
23 one copy of each replacing volume for
the purpose of updating each com-
24 plete set of the Kansas Statutes
Annotated purchased by such member at
25 the serving-legislator price pursuant to
K.S.A. 77-138 and amendments
26 thereto.
27 (d) As used in this
section, ``first term of office in the legislature'' has
28 the meaning ascribed thereto by K.S.A.
77-138 and amendments thereto.
29 Sec. 3. K.S.A.
77-165 is hereby amended to read as follows: 77-165.
30 (a) Such number of copies of the cumulative
supplements for each volume
31 of the Kansas Statutes Annotated,
corresponding as nearly as possible in
32 size and page with the current bound
volumes, as is specified by the
33 revisor of statutes, subject to available
appropriations, shall be printed by
34 the director of printing and delivered to
the secretary of state. Each year
35 such number of sets of the general index
paperbound volume or volumes
36 as is specified by the revisor of statutes,
subject to available appropria-
37 tions, shall be printed by the director of
printing and delivered to the
38 secretary of state. For purposes of this
section the general index paper-
39 bound volume or volumes shall be considered
supplements. The revisor
40 of statutes, with the approval of the
legislative coordinating council, may
41 provide for printing and delivery of
additional copies of supplements to
42 volumes of the Kansas Statutes
Annotated.
43 (b) The secretary of
state shall dispose of full sets of supplements,

1 including the general index
paperbound volume or volumes, as follows:
2 First, by
delivering to all state officers, county officers and other de-
3 partments and officers the same
number of sets and in the same manner
4 as provided by K.S.A. 77-138 and
amendments thereto for the distribu-
5 tion of volumes of the Kansas
Statutes Annotated and (1) by delivering
6 to each member of the legislature
three sets of such supplements (A) one
7 set of the cumulative supplements
for the purpose of updating the com-
8 plete set of Kansas Statutes
Annotated received at the commencement of
9 their first term of office in the
legislature pursuant to K.S.A. 77-138 and
10 amendments thereto, or the complete set
received for the 1999 regular
11 session pursuant to K.S.A. 77-138 and
amendments thereto, and (B) one
12 set of the cumulative supplements for
the purpose of updating each com-
13 plete set of the Kansas Statutes
Annotated purchased by such member at
14 the serving-legislator price pursuant to
K.S.A. 77-138 and amendments
15 thereto, and (2) by delivering to each
former member of the legislature so
16 requesting one set of cumulative
supplements distributed in the first year
17 following the end of such former
member's term of office.
18 Second, the balance of
such supplements including as a part thereof
19 the general index paperbound volume or
volumes, after such distribution,
20 shall be kept by the secretary of state for
sale. Supplements for individual
21 volumes except index volumes shall be sold
at the per volume price fixed
22 therefor by the legislative coordinating
council under this section. Com-
23 plete sets of cumulative supplements
including the general index volume
24 shall be sold at the complete set price
fixed therefor by the legislative
25 coordinating council under this
section.
26 (c) The secretary of
state shall remit all moneys received from the
27 sale of supplements under this section to
the state treasurer at least
28 monthly and the state treasurer shall
deposit the entire amount of each
29 such remittance in the state treasury to
the credit of the state general
30 fund.
31 (d) The legislative
coordinating council shall fix the per volume and
32 complete set prices of the cumulative
supplements for the Kansas Statutes
33 Annotated sold under this section to
recover the costs of printing and
34 binding such supplements. The legislative
coordinating council shall re-
35 vise such prices from time to time for the
purposes of covering and re-
36 covering such costs.
37 (e) As used in this
section, ``first term of office in the legislature'' has
38 the meaning ascribed thereto by K.S.A.
77-138 and amendments thereto.
39 Sec. 4. K.S.A.
77-138, 77-151 and 77-165 are hereby repealed.
40 Sec. 5. This act
shall take effect and be in force from and after its
41 publication in the statute book.
