                    HOUSE BILL No. 2866           By Representative O'Neal           2-10             9             AN ACT concerning cities; relating to the powers and duties of the gov-
10             erning body thereof.

12       Be it enacted by the Legislature of the State of Kansas:
13           Section 1. (a) When used in this section:
14           (1) (A) ``Debt'' shall include, but not be limited to, any special as-
15       sessment; fine or penalty imposed by a municipal court; service fee; ex-
16       cise; fee, charge or other exaction; permit fee; or license fee.
17           (B) ``Debt'' shall not include any property tax.
18           (2) ``Debtor'' means any person who owes a debt to a city.
19           (b) The governing body of any city may adopt an ordinance author-
20       izing the acceptance of credit cards in payment of any debt due and owing
21       to such city. The type of credit cards accepted shall be determined by the
22       governing body.
23           (c) The governing body may fix a fee to be added to each credit card
24       transaction equal to the charge paid by the city for the use of the credit
25       card by the debtor.
26           Sec. 2. This act shall take effect and be in force from and after its
27       publication in the statute book.
