            9             AN ACT concerning background checks on criminal history record
10             information.

12       Be it enacted by the Legislature of the State of Kansas:
13           Section 1. (a) Any county or municipal police department, sheriff's
14       office or countywide law enforcement agency may conduct a background
15       check, which shall be limited to criminal history record information as
16       provided by K.S.A. 22-4701 et seq., and amendments thereto, when so
17       requested by the county or municipal public recreation commission, or
18       the commission's designee, upon any individual who is applying to be a
19       coach, manager, trainer or other person directly associated with a public
20       recreation commission player, contestant or team.
21           (b) The department or agency may charge the commission a reason-
22       able fee for the preparation of a report detailing such criminal history
23       record information, and pursuant to department or agency policy may
24       establish a fee schedule or charge varying rates depending upon the quan-
25       tity of information provided.
26           (c) The department or agency shall be immune from any and all
27       claims or causes of action arising from the release of criminal history
28       record information provided to a commission pursuant to a release signed
29       by an applicant.
30           (d) The commission shall not be liable for any employment decision
31       based upon knowledge of such criminal history record information, pro-
32       vided the information that led to the employment decision reasonably
33       bears upon the applicant's trustworthiness, or the safety or well-being of
34       the public recreation commission player, contestant or team.
35           Sec. 2. This act shall take effect and be in force from and after its
36       publication in the statute book.
