AN ACT establishing the teaching and school
administration professional
10 standards board and
the professional practices commission; providing
11 for the appointment,
composition, powers, duties and functions of such
12 board and commission;
amending K.S.A. 72-1371, 72-1372, 72-1374,
13 72-1381, 72-1383,
72-1387, 72-1388, 72-1389, 72-1392, 72-1393, 72-
14 1394, 72-1395,
72-1396, 72-8502, 72-8503, 72-8505, 72-8506, 72-8507,
15 72-8508 and 72-8509
and repealing the existing sections; also repealing
16 K.S.A. 72-8504 and
72-8514.

18 Be it enacted by the Legislature of the
State of Kansas:
19 Section 1. K.S.A.
72-8502 is hereby amended to read as follows:
20 72-8502. (a) There is hereby established
the teaching and school admin-
21 istration professional standards
advisory board, referred to in this
act as
22 the professional standards board. The
professional standards board shall
23 have 21 members who shall be appointed by
the §ate board of education
24 governor.
25 (b) Candidates for the
professional standards board, with the excep-
26 tion of members appointed under paragraphs
(12) and (13) of subsection
27 (d), shall have the following
qualifications:
28 (1) Either be (A)
certificated and actively practicing in Kansas, or (B)
29 a member of the faculty of an institution
of postsecondary education; and
30 (2) have at least five
years' professional educational experience; and
31 (3) have been in active
practice the immediately preceding three
32 years and at the time of appointment.
33 (c) The
§ate board of education
governor shall obtain nominees for
34 the professional standards board from the
sectors of the profession to be
35 represented on the professional
standards board according to rules and
36 procedures established by the state
board statewide professional associ-
37 ations which are respectively
representative of the positions to be filled.
38 (d) The appointments
made by the §ate board of
education governor
39 shall be representative of the various
elements of the educational com-
40 munity, and shall include the
following:
41 (1) Seven classroom
teachers from the public schools of whom at least
42 one shall be an elementary school teacher,
at least one shall be a junior
43 high or middle school teacher and at least
one shall be a senior high school

1 teacher.
2 (2) One chief
school administrator from the public schools.
3 (3) Three building
level school administrators from the public schools
4 of whom one shall be an elementary
school administrator, one shall be a
5 junior high or middle school
administrator and one shall be a senior high
6 school administrator.
7 (4) One teacher
from an area vocational school or an area vocational-
8 technical school.
9 (5) One special
education teacher from the public schools.
10 (6) One administrator
from an area vocational school or an area vo-
11 cational-technical school.
12 (7) One special
education administrator from the public schools.
13 (8) One classroom
teacher from an accredited nonpublic school.
14 (9) One school
administrator from an accredited nonpublic school.
15 (10) One dean or head of
the school of education of a university under
16 the supervision and control of the state
board of regents.
17 (11) One representative
of the faculty or administration of a private
18 four-year college or university.
19 (12) One representative
of the membership of a parent-teacher as-
20 sociation who has never served on or been
employed by a board of ed-
21 ucation.
22 (13) One person who is a
member of the board of education of a
23 school district.
24 (e) The members
appointed under paragraphs (12) and (13) of sub-
25 section (d) may advise, consult with
and make recommendations to the
26 other members of the professional standards
board, but shall not have
27 the power to vote.
28 (f) The
 c/ommissioner of education or a member of
the staff of the
29 state department of education
recommended by the commissioner shall
30 serve the professional
standards board as secretary may
appoint an ex-
31 ecutive director who shall be in the
unclassified service under the Kansas
32 civil service act and shall receive an
annual salary fixed by the board,
33 subject to approval by the governor. The
professional standards board
34 may employ clerical personnel and other
assistants, all of whom shall be
35 in the classified service under the
Kansas civil service act. The professional
36 standards board may make and enter into
contracts of employment with
37 such professional personnel as
necessary, in the board's judgment, for the
38 performance of its duties and functions
and the execution of its powers.
39 Sec. 2. K.S.A.
72-8503 is hereby amended to read as follows: 72-
40 8503. (a) There is hereby established a
professional practices commission
41 to consist of nine members who shall be
appointed by the §ate board
of
42 education
governor.
43 (b) Candidates for the
practices commission shall have the following

1 qualifications:
2 (1) Be
certificated and actively practicing in Kansas; and
3 (2) have at least
five years' professional educational experience; and
4 (3) have been in
active practice the immediately preceding three
5 years and at the time of
appointment.
6 (c) The
§ate board of education
governor shall obtain nominees for
7 the professional practices commission
from the sectors of the profession
8 to be represented on the
commission according to rules and procedures
9 established by the state
board statewide professional associations which
10 are respectively representative of the
positions to be filled.
11 (d) The appointments
made by the §ate board of
education governor
12 shall include the following:
13 (1) Five classroom
teachers from the public schools of whom at least

(e) The commissioner of education or a
member of the staff of the
23 state department of education
recommended by the commissioner shall
24 serve the practices commission as
secretary.
25 Sec. 3. K.S.A.
72-8505 is hereby amended to read as follows: 72-
26 8505. The professional standards board
shall have the following respon-
27 sibilities and duties:
28 (a) To develop through
the professions of teaching and school ad-
29 ministration and
(Rx)commend for adoption, or amendment and
adoption,
30 by the state board of
education adopt the rules and regulations for
pro-
31 fessional standards governing teacher and
school administrator pretrain-
32 ing selection, teacher and school
administrator preparation, admission to
33 and continuance in the professions of
teaching and school administration,
34 including the requirements of continuing
education for teachers and
35 school administrators.
Nothing in this section shall be construed to
pre-
36 clude the state board of education
from initiating and adopting rules and
37 regulations on the matters
specified in this section, irrespective of any
38 action or lack thereof by the
professional standards board. However, in
39 such instance, the proposed rule
and regulation governing a matter spec-
40 ified in this subsection shall be
submitted to the professional standards
41 board for its recommendation at
least 30 days prior to a motion for adop-
42 tion by the state board of
education. Notwithstanding the foregoing pro-
43 visions of this subsection, if the
state board of education finds that an

1 emergency exists, it may
immediately adopt any rules and regulations
2 without submission to the
professional standards board and without a
3 waiting period.
4 (b) To develop and
(Rx)commend to the state board of education
for
5 adoption thereby
adopt a code of professional responsibility and com-
6 petency for teachers and school
administrators.

Sec. 4. K.S.A. 72-8506 is hereby amended to read as
follows: 72-
8 8506. The professional practices
commission shall exercise disciplinary
9 and advisory functions and shall hear
cases arising under rules and reg-
10 ulations adopted by the
§ate board of education
professional standards
11 board involving the issuance,
suspension, revocation, or reinstatement of
12 teachers' and school administrators'
certificates and render initial orders
13 for disposition
thereof , and the state board of
education. The professional
14 standards board shall review such
initial orders in accordance with the
15 provisions of K.S.A. 77-527. The practices
commission may conduct, upon
16 request and at the direction of the
§ate board of education
professional
17 standards board, investigations of
departures from the code of profes-
18 sional responsibility and competency
which may be adopted by the
§ate
19 board of education upon
recommendation made professional standards
20 board under subsection (b) of K.S.A.
72-8505, and amendments thereto,
21 and report findings thereon to the
§ate board professional
standards
22 board.
23 Sec. 5. K.S.A.
72-8507 is hereby amended to read as follows: 72-
24 8507. (a) The professional practices
commission shall have responsibility,
25 power and authority to investigate problems
relating to the matters spec-
26 ified in K.S.A. 72-8506, and amendments
thereto. Nothing in this section
27 shall be construed to preclude the
state board of education from initiating
28 and adopting rules and regulations
on matters relating to the professions
29 of teaching and school
administration, irrespective of any action or lack
30 thereof by the professional
practices commission.
31 (b) The practices
commission shall have , upon request by and at
the
32 direction of the state board of
education, the responsibility, power and
33 authority to conduct hearings relating to
any case arising under this act,
34 or the act of which this act is amendatory,
or rules and regulations adopted
35 by the §ate board
of education professional standards board.
36 (c) For the purpose of
any investigation which the professional prac-
37 tices commission conducts, the commission
shall have power to  c/onduct
38 such investigation,
administer oaths, take depositions, and by
order of the
39 state board of education,
to issue subpoenas to compel the attendance of
40 witnesses and the production of books,
papers, documents and testimony.
41 If any person refuses to obey any subpoena
so issued, or refuses to testify
42 or produce any books, papers, or documents,
the §ate board of education
43 professional practices commission,
or any member thereof, may present

1 a petition to the district court of
the judicial district in which any inves-
2 tigation is being conducted, setting
forth the facts, and thereupon the
3 court
shall, in a proper case, shall
issue its subpoena to such person,
an
4 order requiring attendance
of such person before the court and there to
5 testify or to produce such books,
papers and documents as may be
6 deemed necessary and pertinent by the
practices commission or any
7 member of
it the commission. Any person
failing or refusing to obey the
8 subpoena or order of the district
court may be proceeded against for
9 contempt in the same manner as for
refusal to obey any other subpoena
10 or order of the court. Hearings before the
practices commission , and any
11 review of orders of the practices
commission by the state board, shall be
12 conducted in accordance with the provisions
of the Kansas administrative
13 procedure act.
14 Sec. 6. K.S.A.
72-8508 is hereby amended to read as follows: 72-
15 8508. (a) Members of the teaching
and school administration professional
16 standards board and the
professional practices commission shall be ap-
17 pointed for three-year terms, and
no person shall be appointed to serve
18 longer than two full terms in
addition to any term of a period less than
19 three years. The initial
appointments shall be made for terms so that
20 approximately 1/3 of the terms
expire each year, which board is abolished
21 by this act, who are serving on such
board on the effective date of this
22 act shall become members of the teaching
and school administration pro-
23 fessional standards board, which board
is established by this act, and shall
24 serve on such board until expiration of
their terms as members of the
25 advisory board. Upon the expiration of a
member's term of office, the
26 governor shall appoint a qualified
successor for a term of three years.
27 Each member shall serve until a
successor is appointed and qualified.
28 Whenever a vacancy occurs in the
membership of the professional stan-
29 dards board prior to the expiration of a
term of office, the governor shall
30 appoint a qualified successor to fill
the unexpired term. No person shall
31 be appointed to serve longer than two
full terms in addition to any term
32 of a period less than three
years.
33 (b) Members of the
professional practices commission, which com-
34 mission is abolished by this act, who
are serving on such commission on
35 the effective date of this act shall
become members of the professional
36 practices commission, which commission
is established by this act, and
37 shall serve on such commission until
expiration of their terms as members
38 of the abolished commission. Upon the
expiration of a member's term of
39 office, the governor shall appoint a
qualified successor for a term of three
40 years. Each member shall serve until a
successor is appointed and qual-
41 ified. Whenever a vacancy occurs in the
membership of the professional
42 practices commission prior to the
expiration of a term of office, the gov-
43 ernor shall appoint a qualified
successor to fill the unexpired term. No

1 person shall be appointed to serve
longer than two full terms in addition
2 to any term of a period less than
three years.

(c) Appointments of members to the professional standards
board and
4 the professional practices
commission to full or unexpired terms shall be
5 made by the governor following the
same procedure as that provided in
6 K.S.A. 75-8502 and 72-8503, and
amendments thereto.

Sec. 7. K.S.A. 72-8509 is hereby amended to read as
follows: 72-
8 8509. The
§ate professional
standards board of education,
either on its
9 own initiative or on the
recommendation of the professional
§andards
10 board or the professional
practices commission, may remove a member
11 of such standards board or practices
commission. Prior to removal of a
12 member, the member shall be given
reasonable notice and hearing in
13 accordance with the provisions of the
Kansas administrative procedure
14 act. Removal of such member shall be
accomplished only by a majority
15 vote of the entire membership of the
§ate professional
standards board.
16 Grounds for removal shall be misconduct
or
17 New Sec. 8. (a) On
July 1, 1998:
18 (1) The teaching and
school administration professional standards ad-
19 visory board established by K.S.A. 72-8502,
prior to its amendment by
20 this act, shall be and is hereby
abolished.
21 (2) The professional
practices commission established by K.S.A. 72-
22 8503, prior to its amendment by this act,
shall be and is hereby abolished.
23 (3) Except as otherwise
provided in this act, all of the powers, duties
24 and functions of the teaching and school
administration professional stan-
25 dards advisory board shall be and are
hereby transferred to and conferred
26 and imposed upon the teaching and school
administration professional
27 standards board established by this
act.
28 (4) All of the records,
memoranda, writings and property of the teach-
29 ing and school administration professional
standards advisory board shall
30 be and are hereby transferred to the
teaching and school administration
31 professional standards board and such board
shall have legal custody of
32 the same.
33 (5) Except as otherwise
provided in this act, all of the powers, duties
34 and functions of the professional practices
commission abolished by this
35 act shall be and are hereby transferred to
and conferred and imposed
36 upon the professional practices commission
established by this act.
37 (6) All of the records,
memoranda, writings and property of the pro-
38 fessional practices commission abolished by
this act shall be and are
39 hereby transferred to the professional
practices commission established
40 by this act and such commission shall have
legal custody of the same.
41 (b) On and after July 1,
1998:
42 (1) The teaching and
school administration professional standards
43 board established by this act shall be the
successor in every way to the

1 powers, duties and functions of the
teaching and school administration
2 professional standards advisory board
in which the same were vested prior
3 to the effective date of this act,
except as otherwise provided in this act.
4 Every act performed under the
authority of the teaching and school ad-
5 ministration professional standards
board established by this act shall be
6 deemed to have the same force and
effect as if performed by the teaching
7 and school administration
professional standards advisory board in which
8 such functions were vested prior to
the effective date of this act.
9 (2) Whenever the
teaching and school administration professional
10 standards advisory board is referred to or
designated by a statute, contract
11 or other document, such reference or
designation shall be deemed to
12 apply to the teaching and school
administration professional standards
13 board established by this act.
14 (3) The teaching and
school administration professional standards
15 board established by this act shall be a
continuation of the teaching and
16 school administration professional
standards advisory board.
17 (4) The professional
practices commission established by this act shall
18 be the successor in every way to the
powers, duties and functions of the
19 professional practices commission abolished
by this act, in which com-
20 mission the same were vested prior to the
effective date of this act, except
21 as otherwise provided in this act. Every
act performed under the authority
22 of the professional practices commission
established by this act shall be
23 deemed to have the same force and effect as
if performed by the profes-
24 sional practices commission abolished by
this act, in which commission
25 such functions were vested prior to the
effective date of this act.
26 (5) Whenever the
professional practices commission is referred to or
27 designated by a statute, contract or other
document, such reference or
28 designation shall be deemed to apply to the
professional practices com-
29 mission established by this act.
30 (6) The professional
practices commission established by this act shall
31 be a continuation of the professional
practices commission abolished by
32 this act.
33 (c) Terms of members of
the professional teaching standards advisory
34 board, the school administrator
professional standards advisory board and
35 the professional teaching practices
commission in office on the effective
36 date of this act shall expire on such date.
Any such members may be
37 appointed by the state board of education
to either the teaching and
38 school administration professional
standards advisory board or the pro-
39 fessional practices commission.
Appointments made under authority of
40 this subsection are subject to the
provisions of K.S.A. 72-8504 and 72-
41 8508, and amendments thereto.
42 Sec. 9. K.S.A.
72-1371 is hereby amended to read as follows: 72-
43 1371. Upon application of any college or
university, or educational insti-

1 tution of like standing, incorporated
under the general laws of the state
2 of Kansas, and requiring a four-year
high-school course or its equivalent,
3 as a condition of admission, the
§ate professional
standards board shall
4 have the power to examine the course
of study prescribed and the char-
5 acter of the work done by
it such institution; and if, in
the judgment of
6 the
§ate professional
standards board, the course of study and the char-
7 acter of the work done shall be of
such standing as to prepare the grad-
8 uates of such institution to teach
successfully in the public schools of this
9 state, and if
said such institution maintains
a department of education and
10 the course of study prescribed includes
work in said such
department
11 satisfactory to the
§ate professional
standards board, the §ate
profes-
12 sional standards board shall place
such institution on the accredited list.
13 Sec. 10. K.S.A.
72-1372 is hereby amended to read as follows: 72-
14 1372. Any institution on the accredited
list shall be subject to examination
15 by the
§ate professional
standards board at its pleasure with respect to
16 its the
institution's course of study, its equipment, and the character
of
17 its work; and additional requirements may
be made by the §ate
profes-
18 sional standards board. Any
institution failing to maintain a standard sat-
19 isfactory to the
§ate professional
standards board shall be dropped from
20 the accredited list.
21 Sec. 11. K.S.A.
72-1374 is hereby amended to read as follows: 72-
22 1374. The provisions of K.S.A. 72-1371 and
72-1372, and amendments
23 thereto, shall apply to state educational
institutions under the control and
24 supervision of the state board of regents,
and may, at the discretion of
25 the §ate
professional standards board, be extended to any institution
in
26 any of the United States which shall
satisfy the §ate professional
stan-
27 dards board, that
it such institution maintains
an efficient department of
28 education, and meets the other requirements
for schools on the accred-
29 ited list.
30 Sec. 12. K.S.A.
72-1381 is hereby amended to read as follows: 72-
31 1381. The
§ate professional
standards board of education, upon
being
32 satisfied as to the general qualifications
of an applicant to teach, may in
33 its discretion issue a special certificate
and specify on the face of such
34 certificate the subject or subjects that
the holder of the certificate is au-
35 thorized to teach. It shall be unlawful for
the holder of a certificate on
36 the face of which is specified the subjects
to teach any subjects not so
37 specified.
38 Sec. 13. K.S.A.
72-1383 is hereby amended to read as follows: 72-
39 1383. Any certificate issued by the
§ate professional
standards board of
40 education or institutions
under the state board of regents may be canceled
41 by the
§ate professional
standards board of education in
the manner
42 provided by law, on the grounds of
immorality, gross neglect of duty,
43 annulling of written contracts with boards
of education without the con-

1 sent of the board which is a party to
the contract, or for any cause that
2 would have justified the withholding
thereof when the same was granted.

Sec. 14. K.S.A. 72-1387 is hereby amended to read as
follows: 72-
4 1387. Each application to the
§ate professional
standards board of edu-
5 cation for
certification, renewal of certification or duplication of
certifi-
6 cation shall be accompanied by a fee
which shall be established by the
7
§ate professional
standards board of education and
shall be in an amount
8 of not less than $18 nor more than
$24. Prior to July 1 of each year, the
9
§ate professional
standards board of education shall
determine the
10 amount of revenue which will be required to
properly administer the
11 provisions of article 13 of chapter 72 of
Kansas Statutes Annotated during
12 the ensuing fiscal year, and shall
establish the certification fee for such
13 year in the amount deemed necessary for
such purposes. The certification
14 fee shall become effective on July 1 of
each year. The §ate
professional
15 standards board
of education shall remit all moneys
received by or for it
16 from fees, charges or penalties to the
state treasurer at least monthly.
17 Upon receipt of each such remittance, the
state treasurer shall deposit
18 the entire amount thereof in the state
treasury and the same shall be
19 credited to the certificate fees fund, and
shall be used only for the pay-
20 ment of expenses connected with the
issuance, renewal, or duplication of
21 such certifications, and for the keeping of
records by the §ate
department
22 of education
professional standards board. All expenditures from the
cer-
23 tificate fees fund shall be made in
accordance with appropriation acts
24 upon warrants of the director of accounts
and reports issued pursuant to
25 vouchers approved by the
§ate professional
standards board of education
26 or by a person or persons designated by
it.
27 Sec. 15. K.S.A.
72-1388 is hereby amended to read as follows: 72-
28 1388. (a) The
§ate professional
standards board of education, in
accord-
29 ance with law, is authorized to adopt rules
and regulations providing for
30 the issuance, renewal, reinstatement and
registration of certificates for
31 teachers and
TMher personnel in the
state department of education and
32 in schools and institutions under the
general supervision of the §ate
pro-
33 fessional standards board
of education.
34 (b) In addition to other
requirements and subject to the provisions
35 of K.S.A. 72-1396, and amendments thereto,
the rules and regulations of
36 the §ate
professional standards board of
education shall include
after
37 May 1, 1986, the
requirement that applicants for initial issuance of cer-
38 tificates to teach shall take and
satisfactorily pass an examination pre-
39 scribed by the
§ate professional
standards board.
40 (c) The privilege to
teach at any level or in any field or subject, if
41 such privilege is or has been granted when
a certificate is issued, may not
42 be withheld during the term for which the
certificate is issued except as
43 provided in K.S.A. 72-1383 or 72-5412, and
amendments to such sections.

Sec. 16. K.S.A. 72-1389 is hereby amended to read as
follows: 72-
2 1389. All teachers' certificates
shall, before issuance, shall
be signed by
3 appropriate personnel of the
§ate department of education
designated
4 by the state
professional standards board of
education and such certifi-
5 cates shall be registered in the
§ate department of education. The
pro-
6 visions of this act shall not
invalidate teachers' certificates that have been
7 duly issued prior to the effective
date of this act.

Sec. 17. K.S.A. 72-1392 is hereby amended to read as
follows: 72-
9 1392. The board of education of any
school district may enter into con-
10 tracts with colleges and universities for
the use of student teachers in the
11 public schools. The
§ate professional
standards board of education,
by
12 rules and regulations, shall provide for
the issuance of student teaching
13 certificates and may authorize persons
holding such student teaching cer-
14 tificates to assume responsibilities of
teachers in schools within limitations
15 prescribed by the
§ate professional
standards board. Student teaching
16 certificates shall be issued without the
charge of any fee or cost by the
17 §ate
professional standards board of
education.
18 Sec. 18. K.S.A.
72-1393 is hereby amended to read as follows: 72-
19 1393. The
§ate professional
standards board of education is
hereby pro-
20 hibited from adopting rules and regulations
which require certification of
21 administrators, teachers or instructors in
any two-year college or in any
22 public community
junior college or which require any
such administra-
23 tors, teachers or instructors to meet any
other conditions for qualification
24 for employment in any such two-year college
or public community junior
25 college. From and after
the effective date of this act, any requirements
26 in any rules and regulations
adopted by the state board of education which
27 conflict with the prohibition
prescribed in this section shall be null and
28 void.
29 Sec. 19. K.S.A.
72-1394 is hereby amended to read as follows: 72-
30 1394. (a) The
§ate professional
standards board of education shall
pre-
31 scribe an examination designed to insure
that certification of a person as
32 a teacher is a reliable indicator that the
person has the basic knowledge
33 and qualifications necessary to engage in
the profession of teaching in
34 this state.
35 (b) In order to comply
with the requirements of subsection (a), the
36 §ate
professional standards board of
education shall select an examina-
37 tion which will measure the basic knowledge
and qualifications of appli-
38 cants for certification as teachers and
shall provide for administration and
39 validation of the examination. The
examination shall be administered to
40 applicants at least two times each calendar
year at various locations within
41 the state.
42 (c) The
§ate professional
standards board of education shall
adopt
43 rules and regulations to guarantee the
confidentiality of the examination,

1 but shall make available to
applicants information regarding examination
2 specifications and shall prescribe
the method by which persons who take
3 the examination may obtain the
results thereof.

Sec. 20. K.S.A. 72-1395 is hereby amended to read as
follows: 72-
5 1395. Any applicant who is seeking
certification to teach in this state and
6 who is required to take the
examination required by this act may apply
7 for and take the examination without
limitation as to the frequency of
8 applications or testing, subject to
any limit imposed by the §ate
profes-
9 sional standards board. The
§ate professional
standards board of edu-
10 cation shall determine the
passing score for the examination which will
11 be required to be attained by applicants as
a prerequisite for certification.
12 An applicant shall not be required to pass
the examination more than
13 once.
14 Sec. 21. K.S.A.
72-1396 is hereby amended to read as follows: 72-
15 1396. (a) Any person holding a teaching
certificate valid in the state of
16 Kansas which was issued prior to May 1,
1986, is exempt from the ex-
17 amination required by this act.
18 (b) The following
persons, or any class or classes thereof, may be
19 exempted by the
§ate professional
standards board of education
from
20 the examination required by this act:
21 (1) Any person holding a
teaching certificate valid in any other state
22 if the requirements under which the
certificate was issued are compara-

examination, for issuance of a teach-
25 ing certificate.
26 (2) Any person applying
for a one-year, nonrenewable certificate if
27 the person meets all certification
requirements, other than examination,
28 for issuance of a teaching certificate.
29 (3) Any person applying
for certification by the §ate
professional
30 standards board to provide services
in a position for which the §ate
pro-
31 fessional standards board deems the
examination is inappropriate or un-
32 necessary if the person meets the
certification requirements which have
33 been established by the
§ate professional
standards board as appropriate
34 and necessary for the position.

38 and 72-8514 are hereby repealed.
39 Sec. 23. This act
shall take effect and be in force from and after its
40 publication in the statute book.
