            9             AN ACT concerning children; relating to the age of eligibility for attend-
10             ance at school; amending K.S.A. 1997 Supp. 72-1107 and repealing
11             the existing section.

13       Be it enacted by the Legislature of the State of Kansas:
14           Section 1. K.S.A. 1997 Supp. 72-1107 is hereby amended to read as
15       follows: 72-1107. (a) Subject to the provisions of subsection (b), any child
16       is eligible to attend the elementary grades in the school district in which
17       the child resides or in a school district which has entered into an agree-
18       ment in accordance with and under authority of K.S.A. 72-8233, and
19       amendments thereto, with the school district in which the child resides
20       if   (1) for the 1994-95 school year, the child will attain the age of six years
21       on or before September 1 of the school year and (2) for the 1995-96
22       school year, the child will attain the age of six years on or before Septem-
23       ber 1 of the school year and (3) for any school year commencing after
24       the 1995-96 school year, the child will attain the age of six years on or
25       before August 31 of the school year or if the child will attain the age of
26       five years on or before August 31 of the school year and the child has
27       completed a kindergarten course entered and attended in this state in
28       accordance with the provisions of subsection (d);
29           (b) any child who has completed a kindergarten course entered and
30       attended in this state in accordance with the provisions of subsection   (d)
31       (e) or who was a resident in another state and who, while residing in such
32       other state, had entered and was in attendance in first grade in such state
33       or who had completed in such state a kindergarten course maintained by
34       a public school district or by an accredited private, denominational or
35       parochial school shall be eligible to attend first grade in this state, re-
36       gardless of age;
37           (c) subject to the provisions of   subsection subsections (d) and (e), any
38       child is eligible to attend kindergarten in the school district in which the
39       child resides or in a school district which has entered into an agreement
40       in accordance with and under authority of K.S.A. 72-8233, and amend-
41       ments thereto, with the school district in which the child resides if   (1) for
42       the 1994-95 school year, the child will attain the age of five years on or
43       before September 1 of the school year and (2) for any school year com-

  1       mencing after the 1994-95 school year, the child will attain the age of five
  2       years on or before August 31 of the school year;
  3           (d) any child is eligible to attend kindergarten in the school district
  4       in which the child resides or in a school district which has entered into
  5       an agreement in accordance with and under authority of K.S.A. 72-8233,
  6       and amendments thereto, with the school district in which the child re-
  7       sides if the child will attain the age of four years on or before August 31
  8       of the school year, the capacity of the kindergarten class is sufficient to
  9       permit attendance of the child, and the school district has determined
10       through appropriate screening that the child is ready for attendance in
11       kindergarten; and
12             (d) (e) any child who was a resident in another state and who, while
13       residing in such other state, had entered and was in attendance in kin-
14       dergarten in such state shall be eligible to attend kindergarten in this
15       state, regardless of age.
16           Sec. 2. K.S.A. 1997 Supp. 72-1107 is hereby repealed.
17           Sec. 3. This act shall take effect and be in force from and after its
18       publication in the statute book.
