AN ACT concerning public buildings; relating
to enforcement of acces-
10 sibility standards;
amending K.S.A. 58-1304 and repealing the existing
11 section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section 1. K.S.A.
58-1304 is hereby amended to read as follows:
15 58-1304. (a) The responsibility for
enforcement of this act shall be as
16 follows: (1) For all existing Title II
school facilities, and the design and
17 construction of all new, additions to and
alterations of Title II school
18 facilities, the state board of education,
by plan approval as required by
19 K.S.A. 31-150, and amendments thereto.
School facilities under the con-
20 trol of the state board of regents shall
not be subject to the provisions of
21 this subsection;
22 (2) for all existing
state government facilities, and the design and con-
23 struction of all new, additions to and
alterations of, facilities for which
24 federal, state, county funds or funds of
other political subdivisions of the
25 state or private funds are utilized on
state property, the secretary of ad-
26 ministration;
27 (3) for all existing
local government facilities, and the design and con-
28 struction of all new, additions to and
alterations of, any local government
29 facilities where funds of a county,
municipality or other political subdi-
30 vision are utilized, the governmental
entity thereof or an agency thereof
31 designated by the governmental entity;
32 (4) for the design and
construction of all other new, additions to and
33 alterations of, facilities which are
subject to the provisions of this act, the
34 building inspector or other agency or
person designated by the govern-
35 mental entity in which the facility is
located.
36 (b) The attorney general
of the state of Kansas shall oversee the en-
37 forcement of this act.
38 Sec. 2. K.S.A.
58-1304 is hereby repealed.
39 Sec. 3. This act
shall take effect and be in force from and after its
40 publication in the Kansas register.
