            9             AN ACT concerning certification of code enforcement officers.
10            
11       Be it enacted by the Legislature of the State of Kansas:
12           Section 1. This act shall be known and may be cited as the certifi-
13       cation of code enforcement officers act of the state of Kansas.
14           Sec. 2. The legislature of the state of Kansas finds that the Kansas
15       association of code enforcement, inc. was established for the purpose of
16       studying and advancing the science and practice of code enforcement
17       through the professional training and education of code enforcement of-
18       ficers in the state of Kansas leading to their certification; that cities and
19       counties in the state of Kansas have the authority to enact codes to en-
20       hance and protect the general and public health, safety and welfare of
21       the citizens in this state; that code enforcement officers are responsible
22       for ensuring the adherence to and enforcement of these codes; and there-
23       fore it is in the public interest of this state and the quality of life in Kansas
24       to promote and encourage the professional training and education leading
25       to certification of code enforcement officers throughout Kansas.
26           Sec. 3. As used in this act:
27           (a) ``K.A.C.E.'' means the Kansas association of code enforcement,
28       inc.
29           (b) ``Certification'' means the formal designation conferred upon a
30       code enforcement officer who has fulfilled the professional training and
31       educational requirements and standards established by K.A.C.E. for cer-
32       tification.
33           (c) ``Code'' means any code as defined under the provisions of K.S.A.
34       12-3301, and amendments thereto.
35           (d) ``Code enforcement officer'' means any designated officer or em-
36       ployee of a city or county, whose duties include the detection of violations
37       and enforcement of codes enacted by a city or county.
38           Sec. 4. Requirements for certification of code enforcement officers
39       in this state shall be established by K.A.C.E. which shall adopt rules and
40       regulations governing certification standards and the subject, scope and
41       form of professional training and education necessary for certification or
42       shall contract with an educational institution to provide the training and
43       education approved by K.A.C.E.

  1           Sec. 5. This act shall take effect and be in force from and after its
  2       publication in the statute book.
