AN ACT establishing the Kansas
highway transportation trust fund; pro-
19 viding for certain
transfers; payment of employee bonuses.

21 Be it enacted by the Legislature of the
State of Kansas:
22 Section 1. (a)
There is hereby established in the state treasury the
23 Kansas highway
transportation trust fund.
24 (b) Moneys in the Kansas
highway transportation trust fund shall
25 be used only for the purpose of paying
costs associated with the imple-
26 mentation of any highway
transportation program authorized by statute
27 and initiated after July 1,
2002.
28 (c) On or before the
10th of each month, the director of accounts
29 and reports shall transfer from the state
general fund to the Kansas high-
30 way transportation
trust fund interest earnings based on:
31 (1) The average daily
balance of moneys in the Kansas highway
trans-
32 portation trust fund for the
preceding month; and
33 (2) the net earnings
rate for the pooled money investment portfolio
34 for the preceding month.
35 (d) On July 1,
2002, the director of accounts and reports shall
transfer
36 all moneys in the Kansas highway
trust fund to the state highway fund
37 and upon such transfer the Kansas
highway trust fund is hereby abolished.
38 (d) Upon
written request by the secretary of transportation,
39 the director of accounts and reports
shall transfer the amount
40 specified in such request from the
Kansas transportation trust fund
41 to the state highway fund.
42 Sec. 2. (a) On June
30, 1998, the director of accounts and reports
43 shall transfer $25,000,000 from the state
general fund to the Kansas high-

transportation trust fund established by section 1.
2 (b) On July 15,
1998, and on the 15th day of each calendar quarter
3 thereafter before July 1, 2002, the
director of accounts and reports shall
4 transfer $6,250,000 from the state
general fund to the Kansas highway
5 transportation trust fund
established by section 1.

Sec. 3. (a) In order to help fund any highway
program authorized by
7 statute initiated after July
1, 2002, the agency head of each state agency
8 having appropriations from
the state general fund demonstrating actual
9 cost reductions in the
operations of such state agency for any fiscal year
10 ending prior to July 1, 2002, shall
certify such savings to the director of
11 accounts and reports. Upon receipt
of such certification, the director of
12 accounts and reports shall transfer
80% of the amount so certified from
13 the accounts of the state agency
specified therefor to the Kansas highway
14 trust fund.
15 (b) The
remaining 20% of the amount certified under subsection
(a)
16 shall be used for the payment of
cash bonuses to state officers and em-
17 ployees of the agency demonstrating
cost reductions. The agency head
18 shall have discretion as to the
payment of such bonuses. Such bonuses
19 shall be paid from money
appropriated in any item of appropriation from
20 which expenditures are so certified
as reduced.
21 (c) No cash
bonus payment to any person pursuant to this section
22 shall be compensation, within the
meaning of K.S.A. 74-4901 et
seq., and
23 amendments thereto, for any purpose
under the Kansas public employees
24 retirement system and shall not be
subject to deductions for employee
25 contributions thereunder. Each such
cash bonus payment shall be a bo-
26 nus, as defined by 289 C.F.R. 778,
and shall be in addition to the regular
27 earnings to which an officer or
employee may be entitled or for which
28 such officer or employee may become
eligible.
29 (d) As used in
this section:
30 (1) ``State
agency'' means any state office or officer,
department,
31 board, commission, bureau,
division, authority, agency or institution of
32 this state, except political
subdivisions of the state, requesting or receiving
33 appropriations from the state
treasury; and
34 (2) ``agency
head'' means an individual or body of individuals in
which
35 the ultimate legal authority of the
state agency is vested by any provision
36 of law.
37 Sec. 4
3. This act shall take effect and be in force from and
after its
38 publication in the Kansas register.
