            9             AN ACT concerning accident and health insurance; relating to coverage
10             for oral surgery.

12       Be it enacted by the Legislature of the State of Kansas:
13           Section 1. (a) Except as otherwise provided, this act applies to any
14       individual, group or blanket policy of accident and sickness, medical or
15       surgical expense coverage and any provision of a policy, contract, plan or
16       agreement for medical service including any contract of a health main-
17       tenance organization as defined by K.S.A. 40-3202, and amendments
18       thereto, delivered, renewed or issued for delivery on or after the effective
19       date of this act within or outside of this state or used within this state by
20       or for an individual who resides or is employed in this state. The provisions
21       of this act shall not apply to any medicare supplement policy of insurance,
22       as defined by the commissioner of insurance by rule and regulation, any
23       policy of long-term care insurance, as defined by K.S.A. 40-2227, and
24       amendments thereto, any specified disease or specified accident coverage
25       or any accident only coverage as defined by the commissioner of insur-
26       ance by rule and regulation whether written on a group, blanket or in-
27       dividual basis.
28           (b) Notwithstanding any provision of any policy, provision, contract,
29       plan or agreement to which this act applies, whenever reimbursement or
30       indemnity for oral surgery is covered, reimbursement and indemnifica-
31       tion for hospitalization during the performance of oral surgery shall not
32       be denied when such surgery is performed at the direction of and deter-
33       mined to be necessary by a person licensed to practice such surgery by
34       the board of healing arts within the lawful scope of such person's license.
35       A policy, provision, contract, plan or agreement may apply to hospitali-
36       zation benefits for oral surgery, the same deductibles, coinsurance and
37       other limitations as apply to other covered services.
38           Sec. 2. This act shall take effect and be in force from and after its
39       publication in the statute book.
