                    HOUSE BILL No. 2798           By Committee on Environment           2-4             9             AN ACT concerning confined feeding facilities for swine; prohibiting the
10             issuance of certain permits therefor.

12       Be it enacted by the Legislature of the State of Kansas:
13           Section 1. (a) As used in this section, terms have the meanings pro-
14       vided by K.S.A. 65-171d and amendments thereto.
15           (b) Notwithstanding any other provision of law to the contrary, on
16       and after the effective date of this act and before January 1, 2001, the
17       secretary of health and environment shall not issue any water pollution
18       control permit for:
19           (1) Any new confined feeding facility for swine that has a capacity of
20       500 or more animal units;
21           (2) expansion of any existing confined feeding facility for swine to a
22       capacity of 500 or more animal units; or
23           (3) expansion of any existing confined feeding facility for swine that
24       has a capacity of 500 or more animal units.
25           (c) Nothing in this section shall prohibit renewal of a water pollution
26       control permit that was issued by the secretary before January 1, 1998.
27           Sec. 2. This act shall take effect and be in force from and after its
28       publication in the Kansas register.
