AN ACT concerning wildlife; providing for
permits for and regulation of
10 importation and
possession of certain snakes; amending K.S.A. 1997
11 Supp. 32-988 and
repealing the existing section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 New Section 1. (a)
Except as otherwise provided by law or rules and
15 regulations of the secretary, a poisonous
snake permit is required to im-
16 port or possess any poisonous snake that is
not indigenous to Kansas.
17 (b) The provisions of
subsection (a) shall not apply to the importation
18 or possession of any snake as authorized by
another permit or license
19 issued by the department.
20 (c) The fee for a
poisonous snake permit shall be the amount pre-
21 scribed pursuant to K.S.A. 32-988 and
amendments thereto.
22 (d) The secretary shall
adopt, in accordance with K.S.A. 32-805 and
23 amendments thereto, such rules and
regulations as necessary to imple-
24 ment this section. Such rules and
regulations shall include, but not be
25 limited to, a requirement that any person
importing or possessing any
26 poisonous snake that is not indigenous to
Kansas shall:
27 (1) Report to the
department the number and type of each such snake
28 imported or possessed, from whom the snake
was obtained and any per-
29 son to whom the snake is transferred;
30 (2) submit to the
department every three months a report of each
31 such snake's status;
32 (3) submit to the
department, suitably identified and with warning
33 labels, the head of any such snake that
dies; and
34 (4) allow personnel of
the department to inspect, during reasonable
35 hours, the premises where any such snake is
to account for each such
36 snake.
37 Sec. 2. K.S.A. 1997
Supp. 32-988 is hereby amended to read as fol-
38 lows: 32-988. (a) The secretary is
authorized to adopt, in accordance with
39 K.S.A. 32-805 and amendments thereto, rules
and regulations fixing the
40 amount of fees for the following items,
subject to the following limitations
41 and subject to the requirement that no such
rules and regulations shall
42 be adopted as temporary rules and
regulations:

25 (b) The fee for a
landowner-tenant resident big game hunting permit
26 shall be an amount equal to 1/2 the fee for
a general resident big game
27 hunting permit.
28 (c) The fee for a
furharvester license for a resident under 16 years of
29 age shall be an amount equal to 1/2 the fee
for a resident furharvester
30 license.
31 (d) The secretary may
establish, by rules and regulations adopted in
32 accordance with K.S.A. 32-805 and
amendments thereto, different fees
33 for various classes and types of licenses,
permits, stamps and other issu-
34 ances of the department which may occur
within each item as described
35 under subsection (a).
36 (e) The fee for a
nonprofit group fishing license issued under
sub-
37 section (h) of K.S.A. 32-906 and
amendments thereto shall be $50 for
38 calendar year 1995.
39 (f) The fee for
a nonresident mussel fishing license shall be $1,000
40 from the effective date of this act
through calendar year 1995 poisonous
41 snake permit issued under section 1
shall be $10 for calendar year 1998.
42 Sec. 3. K.S.A. 1997
Supp. 32-988 is hereby repealed.

act shall take effect and be in force from and after its
2 publication in the statute book.
