AN ACT relating to the state health care benefits
system; concerning
15 eligibility for
participation therein; amending K.S.A. 75-6501 and re-
16 pealing the existing
section.

18 Be it enacted by the Legislature of the
State of Kansas:
19 Section 1. K.S.A.
75-6501 is hereby amended to read as follows:
20 75-6501. (a) Within the limits of
appropriations made or available therefor
21 and subject to the provisions of
appropriation acts relating thereto, the
22 Kansas state employees health care
commission shall develop and provide
23 for the implementation and administration
of a state health care benefits
24 program.
25 (b) The state health
care benefits program may provide benefits for
26 persons qualified to participate in the
program for hospitalization, medical
27 services, surgical services, nonmedical
remedial care and treatment ren-
28 dered in accordance with a religious method
of healing and other health
29 services. The program may include such
provisions as are established by
30 the Kansas state employees health care
commission, including but not
31 limited to qualifications for benefits,
services covered, schedules and
32 graduation of benefits, conversion
privileges, deductible amounts, limi-
33 tations on eligibility for benefits by
reason of termination of employment
34 or other change of status, leaves of
absence, military service or other
35 interruptions in service and other
reasonable provisions as may be estab-
36 lished by the commission.
37 (c) The Kansas state
employees health care commission shall desig-
38 nate by rules and regulations those persons
who are qualified to partici-
39 pate in the state health care benefits
program, including active and retired
40 public officers and employees and their
dependents as defined by rules
41 and regulations of the commission. In
designating persons qualified to
42 participate in the state health care
benefits program, the commission may
43 establish such conditions, restrictions,
limitations and exclusions as the

1 commission deems reasonable. On
and after July 1, 1998, employees, as
2 defined in K.S.A. 74-4932 and
amendments thereto, and their dependents
3 shall be qualified for
participation in the system. Each person who was
4 formerly elected or appointed and
qualified to an elective state office and
5 who was covered immediately preceding
the date such person ceased to
6 hold such office by the provisions of
group health insurance or a health
7 maintenance organization plan under
the law in effect prior to August 1,
8 1984, or the state health care
benefits program in effect after that date,
9 shall continue to be qualified to
participate in the state health care ben-
10 efits program and shall pay the cost of
participation in the program as
11 established and in accordance with the
procedures prescribed by the com-
12 mission if such person chooses to
participate therein.
13 (d) The state health
care benefits program established under this act
14 shall be effective on and after August 1,
1984.
15 Sec. 2. K.S.A.
75-6501 is hereby repealed.
16 Sec. 3. This act
shall take effect and be in force from and after its
17 publication in the statute book.
