AN ACT concerning school district finance; providing
weighting for main-
13 tenance of preferred
pupil/teacher ratio (PTR) classes; amending
14 K.S.A. 1997 Supp.
72-6407 and repealing the existing section.

16 Be it enacted by the Legislature of the
State of Kansas:
17 Section 1. K.S.A.
1997 Supp. 72-6407 is hereby amended to read as
18 follows: 72-6407. (a) ``Pupil'' means any
person who is regularly enrolled
19 in a district and attending kindergarten or
any of the grades one through
20 12 maintained by the district or who is
regularly enrolled in a district and
21 attending kindergarten or any of the grades
one through 12 in another
22 district in accordance with an agreement
entered into under authority of
23 K.S.A. 72-8233, and amendments thereto, or
who is regularly enrolled in
24 a district and attending special education
services provided for preschool-
25 aged exceptional children by the district.
Except as otherwise provided
26 in this subsection, a pupil in attendance
full time shall be counted as one
27 pupil. A pupil in attendance part time
shall be counted as that proportion
28 of one pupil (to the nearest 1/10) that the
pupil's attendance bears to
29 full-time attendance. A pupil attending
kindergarten shall be counted as
30 1/2 pupil. A pupil enrolled in and
attending an institution of postsecondary
31 education which is authorized under the
laws of this state to award aca-
32 demic degrees shall be counted as one pupil
if the pupil's postsecondary
33 education enrollment and attendance
together with the pupil's attend-
34 ance in either of the grades 11 or 12 is at
least 5/6 time, otherwise the
35 pupil shall be counted as that proportion
of one pupil (to the nearest 1/10)
36 that the total time of the pupil's
postsecondary education attendance and
37 attendance in grade 11 or 12, as
applicable, bears to full-time attendance.
38 A pupil enrolled in and attending an area
vocational school, area voca-
39 tional-technical school or approved
vocational education program shall be
40 counted as one pupil if the pupil's
vocational education enrollment and
41 attendance together with the pupil's
attendance in any of grades nine
42 through 12 is at least 5/6 time, otherwise
the pupil shall be counted as that
43 proportion of one pupil (to the nearest
1/10) that the total time of the

1 pupil's vocational education
attendance and attendance in any of grades
2 nine through 12 bears to full-time
attendance. A pupil enrolled in a dis-
3 trict and attending special education
services, except special education
4 services for preschool-aged
exceptional children, provided for by the dis-
5 trict shall be counted as one pupil.
A pupil enrolled in a district and
6 attending special education services
for preschool-aged exceptional chil-
7 dren provided for by the district
shall be counted as 1/2 pupil. A pupil in
8 the custody of the secretary of
social and rehabilitation services and en-
9 rolled in unified school district No.
259, Sedgwick county, Kansas, but
10 housed, maintained, and receiving
educational services at the Judge James
11 V. Riddel Boys Ranch, shall be counted as
two pupils. A pupil residing at
12 the Flint Hills job corps center shall not
be counted. A pupil confined in
13 and receiving educational services provided
for by a district at a juvenile
14 detention facility shall not be counted. A
pupil enrolled in a district but
15 housed, maintained, and receiving
educational services at a state institu-
16 tion shall not be counted.
17 (b) ``Preschool-aged
exceptional children'' means exceptional chil-
18 dren, except gifted children, who have
attained the age of three years but
19 are under the age of eligibility for
attendance at kindergarten.
20 (c) ``At-risk pupils''
means pupils who are eligible for free meals un-
21 der the national school lunch act and who
are enrolled in a district which
22 maintains an approved at-risk pupil
assistance plan.
23 (d) ``Enrollment''
means, for districts scheduling the school days or
24 school hours of the school term on a
trimestral or quarterly basis, the
25 number of pupils regularly enrolled in the
district on September 20 plus
26 the number of pupils regularly enrolled in
the district on February 20
27 less the number of pupils regularly
enrolled on February 20 who were
28 counted in the enrollment of the district
on September 20; and for dis-
29 tricts not hereinbefore specified, the
number of pupils regularly enrolled
30 in the district on September 20.
Notwithstanding the foregoing, if en-
31 rollment in a district in any school year
has decreased from enrollment
32 in the preceding school year, enrollment of
the district in the current
33 school year may be computed on the basis of
enrollment in the preceding
34 school year.
35 (e) ``Adjusted
enrollment'' means enrollment adjusted by adding at-
36 risk pupil weighting, program weighting,
low enrollment weighting, if any,
37 correlation weighting, if any, school
facilities weighting, if any, ancillary
38 school facilities weighting, if any,
preferred PTR weighting, if any, and
39 transportation weighting to enrollment.
40 (f) ``At-risk pupil
weighting'' means an addend component assigned
41 to enrollment of districts on the basis of
enrollment of at-risk pupils.
42 (g) ``Program
weighting'' means an addend component assigned to
43 enrollment of districts on the basis of
pupil attendance in educational

1 programs which differ in cost from
regular educational programs.
2 (h) ``Low
enrollment weighting'' means an addend component as-
3 signed to enrollment of districts
having under 1,800 enrollment on the
4 basis of costs attributable to
maintenance of educational programs by such
5 districts in comparison with costs
attributable to maintenance of educa-
6 tional programs by districts having
1,800 or over enrollment.
7 (i) ``School
facilities weighting'' means an addend component as-
8 signed to enrollment of districts on
the basis of costs attributable to com-
9 mencing operation of new school
facilities. School facilities weighting may
10 be assigned to enrollment of a district
only if the district has adopted a
11 local option budget and budgeted therein
the total amount authorized for
12 the school year. School facilities
weighting may be assigned to enrollment
13 of the district only in the school year in
which operation of a new school
14 facility is commenced and in the next
succeeding school year.
15 (j) ``Transportation
weighting'' means an addend component assigned
16 to enrollment of districts on the basis of
costs attributable to the provision
17 or furnishing of transportation.
18 (k) ``Correlation
weighting'' means an addend component assigned to
19 enrollment of districts having 1,800 or
over enrollment on the basis of
20 costs attributable to maintenance of
educational programs by such dis-
21 tricts as a correlate to low enrollment
weighting assigned to enrollment
22 of districts having under 1,800
enrollment.
23 (l) ``Ancillary school
facilities weighting'' means an addend compo-
24 nent assigned to enrollment of districts to
which the provisions of K.S.A.
25 1997 Supp. 72-6441, and amendments thereto,
apply on the basis of costs
26 attributable to commencing operation of new
school facilities. Ancillary
27 school facilities weighting may be assigned
to enrollment of a district only
28 if the district has levied a tax under
authority of K.S.A. 1997 Supp. 72-
29 6441, and amendments thereto, and remitted
the proceeds from such tax
30 to the state treasurer. Ancillary school
facilities weighting is in addition
31 to assignment of school facilities
weighting to enrollment of any district
32 eligible for such weighting.
33 (m) ``Preferred PTR
weighting'' means an addend component as-
34 signed to enrollment of districts having
over 1,523 enrollment on the basis
35 of costs attributable to maintenance of
preferred PTR classes for pupils
36 enrolled in and attending kindergarten
or any of the grades one through
37 three.
38 (n) ``Preferred PTR
class'' means a class having a pupil/teacher ration
39 of not more than 17:1.
40 New Sec. 2. (a) The
preferred PTR weighting of each district with
41 1,524-1,799 enrollment shall be determined
by the state board in each
42 school year in which the district maintains
one or more preferred PTR
43 classes as follows:

1 (1) Determine the
number of pupils included in enrollment of the
2 district and attending kindergarten
or any of the grades one through three
3 in a preferred PTR class;
4 (2) subtract 1,523
from enrollment of the district and multiply the
5 remainder by .000361;
6 (3) multiply the
number of pupils determined under (1) by the prod-
7 uct obtained under (2). The product
obtained under this provision (3) is
8 the preferred PTR weighting of the
district.
9 (b) The preferred
PTR weighting of each district with 1,800 or over
10 enrollment shall be determined by the state
board in each school year in
11 which the district maintains one or more
preferred PTR classes by mul-
12 tiplying the number of pupils included in
enrollment of the district and
13 attending kindergarten or any of the grades
one through three in a pre-
14 ferred PTR class by .10. The product
obtained under this subsection is
15 the preferred PTR weighting of the
district.
16 Sec. 3. K.S.A. 1997
Supp. 72-6407 is hereby repealed.
17 Sec. 4. This act
shall take effect and be in force from and after its
18 publication in the statute book.
