AN ACT regulating traffic; concerning bicycles
single-file; exceptions;
10 amending K.S.A. 1997
Supp. 8-1590 and repealing the existing section.

12 Be it enacted by the Legislature of the
State of Kansas:
13 Section 1. K.S.A. 1997 Supp.
8-1590 is hereby amended to read as
14 follows: 8-1590. (a) Every person operating
a bicycle or a moped upon a
15 roadway at less than the normal speed of
traffic at the time and place and
16 under the conditions then existing shall
ride as near to the right side of
17 the roadway as practicable, except under
any of the following situations
18 when: (1) Overtaking and passing another
bicycle or vehicle proceeding
19 in the same direction; (2) preparing for a
left turn at an intersection or
20 into a private road or driveway; or (3)
reasonably necessary to avoid con-
21 ditions including, but not limited to,
fixed or moving objects, parked or
22 moving bicycles, bicycles, pedestrians,
animals, surface hazards or narrow
23 width lanes that make it unsafe to continue
along the right-hand edge of
24 the roadway.
25 (b) Any person operating a
bicycle or a moped upon a one-way high-
26 way with two or more marked traffic lanes
may ride as near to the left
27 side of the roadway as practicable.
28 (c) Persons riding bicycles
upon a roadway shall not ride more than
29 two abreast ride
single-file, except on paths or parts of roadways set aside
30 for the exclusive use of bicycles. A
city may authorize persons riding
31 bicycles upon a roadway within the
corporate limits of such city to ride
32 not more than two abreast.
33 (d) Wherever a usable path
for bicycles has been provided adjacent
34 to a roadway, bicycle riders shall use such
path and shall not use the
35 roadway.
36 (e) For purposes of this
section, ``narrow width lane'' means a lane
37 that is too narrow for a bicycle and a
vehicle to travel safely side-by-side
38 within the lane.
39 Sec. 2. K.S.A. 1997 Supp.
8-1590 is hereby repealed.
40 Sec. 3. This act shall take
effect and be in force from and after its
41 publication in the statute book.
