AN ACT concerning the state corporation
commission; relating to the
10 executive director
thereof; amending K.S.A. 1997 Supp. 74-629 and
11 74-630 and repealing
the existing sections.

13 Be it enacted by the Legislature of the
State of Kansas:
14 New Section 1. (a) The
governor shall appoint, subject to confir-
15 mation by the senate as provided by K.S.A.
75-4315b and amendments
16 thereto, the executive director of the
state corporation commission. The
17 executive director shall serve at the
pleasure of the governor and under
18 the direction and supervision of the
commission. The executive director
19 shall be in the unclassified service under
the Kansas civil service act and
20 shall receive compensation fixed by the
governor, subject to the limita-
21 tions of appropriations therefor.
22 (b) The executive director
shall perform such duties and exercise
23 powers as are delegated by the state
corporation commission and such
24 duties and powers as are prescribed by law.
The executive director shall
25 also serve as secretary to the
commission.
26 Sec. 2. K.S.A. 1997 Supp.
74-629 is hereby amended to read as fol-
27 lows: 74-629. The state corporation
commission is authorized to organize
28 the office of the state corporation
commission as it deems most efficient,
29 so long as the same is not in conflict with
law. Division directors, and
30 other directors specified in subsection (b)
of K.S.A. 1997 Supp. 74-630
31 and amendments thereto, and
the general counsel and the executive di-
32 rector shall perform such
duties and exercise powers as are delegated by
33 the state corporation commission and such
duties and powers as are pre-
34 scribed by law.
35 Sec. 3. K.S.A. 1997 Supp.
74-630 is hereby amended to read as fol-
36 lows: 74-630. (a) The state corporation
commission may appoint persons
37 to the positions specified in subsection
(b) to serve as full-time employees
38 of the state. Such persons shall be in the
unclassified service of the Kansas
39 civil service act and shall receive
compensation fixed by the state corpo-
40 ration commission and approved by the
governor, subject to the limita-
41 tions of appropriations therefor.
42 (b) The offices to which this
section apply are the following:
43 (1) The director of the
division of utilities;

1 (2) the director of the
division of conservation;
2 (3) the director of the
division of transportation;
3 (4) the director of
public affairs and consumer protection; and
4 (5) the general
counsel; and
5 (6) the
executive director, who shall also serve as secretary to the
state
6 corporation
commission.
7 Sec. 4. K.S.A. 1997
Supp. 74-629 and 74-630 are hereby repealed.
8 Sec. 5. This act shall
take effect and be in force from and after its
9 publication in the statute book.
