AN ACT concerning retail electric bills to consumers;
providing for dis-
11 closure of certain
components.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section 1. (a) As
used in this section:
15 (1) ``Commission'' means
the state corporation commission.
16 (2) ``Distribution
services'' means services provided from the point
17 where electricity enters the distribution
system to the point at which the
18 electricity is delivered to consumers.
19 (3) ``Generation
services'' means provision of electricity and capacity
20 to generate electricity but does not
include transmission or distribution
21 services.
22 (4) ``Electric
cooperative'' means an electric cooperative public utility
23 that is not subject to the jurisdiction of
the commission.
24 (5) ``Electric public
utility'' means an electric public utility, as defined
25 by K.S.A. 66-101a and amendments thereto,
that is subject to the juris-
26 diction of the commission but does not
include any municipal electric
27 utility or portion thereof.
28 (6) ``Transmission
services'' means services provided from the point
29 where electricity is generated to the point
at which the electricity enters
30 the distribution system.
31 (b) Before January 1,
1999, the commission shall adopt rules and
32 regulations requiring that, on and after
January July 1, 2000, an
electric
33 public utility's retail electric bills to
consumers shall disclose the com-
34 ponents specified by subsection (d) and
such other components as the
35 commission determines will adequately
inform consumers.
36 (c) On and after
January July 1, 2000:
37 (1) An electric
cooperative public utility's retail electric bills to con-
38 sumers shall disclose the components
specified by subsection (d) and such
39 additional components as the cooperative
determines will adequately in-
40 form consumers; and

(2) a municipal electric if a
municipal electric utility's annual
42 gross revenues are $500,000 or more,
such utility's retail electric bills
43 to consumers shall disclose the components
specified by subsection (d),

1 the component attributable to
budgeted transfers to the city general fund
2 and such additional components as the
governing body of the municipality
3 determines will adequately inform
consumers.
4 (d) The following
components are required to be disclosed pursuant
5 to subsections (b) and (c):
6 (1) Generation
service charges;
7 (2) distribution
service charges;
8 (3) transmission
service charges; and

(4) ·ansactional taxes
sales, use and franchise taxes, and any fees,
10 relating to the sale or furnishing of
electricity at retail ; and
11 (5) the portion
of the bill attributable to other taxes included in
rates.
12 (e) All
reasonable costs of complying with this section shall be
13 recoverable through a competitive
transaction charge to be deter-
14 mined by the commission, except to the
extent that the commission
15 determines recovery will be completed
through regulated rates.
16 Sec. 2. This act
shall take effect and be in force from and after its
17 publication in the
§atute book Kansas
register.
