                    HOUSE BILL No. 2669           By Committee on Health and Human Services           1-20             9             AN ACT concerning the reporting of abuse, neglect or exploitation of
10             certain persons; amending K.S.A. 39-1409 and repealing the existing
11             section.

13       Be it enacted by the Legislature of the State of Kansas:
14           Section 1. K.S.A. 39-1409 is hereby amended to read as follows:
15       39-1409. In performing the duties set forth in this act, the secretary of
16       social and rehabilitation services or the secretary of health and environ-
17       ment may request the assistance of the staffs and resources of all appro-
18       priate state departments, agencies and commissions and local health de-
19       partments and may utilize any other public or private agency, group or
20       individual who is appropriate and who may be available to assist such
21       department in the investigation and determination of whether a resident
22       is being, or has been, abused, neglected or exploited or is in a condition
23       which is a result of such abuse, neglect or exploitation, except that any
24       internal investigation conducted by any caretaker under investigation
25       shall not serve in lieu of, but shall be in addition to, an independent
26       investigation by the department of health and environment or the de-
27       partment of social and rehabilitation services.
28           Sec. 2. K.S.A. 39-1409 is hereby repealed.
29           Sec. 3. This act shall take effect and be in force from and after its
30       publication in the statute book.
