AN ACT concerning governmental ethics;
relating to lobbyists; amending
10 K.S.A. 1997 Supp.
46-269 and repealing the existing section.

12 Be it enacted by the Legislature of the
State of Kansas:
13 Section 1. K.S.A. 1997 Supp.
46-269 is hereby amended to read as
14 follows: 46-269. Each report under K.S.A.
46-268, and amendments
15 thereto, shall disclose the following:
16 (a) The full name and address
of each person who has paid compen-
17 sation for lobbying to the lobbyist or has
paid for expenses of lobbying by
18 the lobbyist during the period
reported.
19 (b) The aggregate amount or
value of all expenditures made, except
20 for expenses of general office overhead, by
the lobbyist or by the lobbyist's
21 employer for or in direct relation to
lobbying during the reporting period,
22 if such expenditures exceed $100.
Individual expenditures of less than $2
23 shall not be required to be reported under
this subsection. Every lobbyist
24 shall keep detailed accounts of all
expenditures required to be reported
25 pursuant to K.S.A. 46-268, and amendments
thereto. Such expenditures
26 shall be reported according to the
following categories of expenditures:
27 (1) Food and beverages
provided as hospitality;
28 (2) entertainment, gifts,
honoraria or payments;
29 (3) mass media
communications;
30 (4) recreation provided as
hospitality;
31 (5) communications for the
purpose of influencing legislative or ex-
32 ecutive action; and
33 (6) (A) all other
reportable expenditures made in the performance
34 of services as a lobbyist.
35 With regard to expenditures for
entertainment or hospitality which is
36 primarily recreation, food and beverages,
only amounts expended on a
37 state officer or employee or on such
officer or employee's spouse guests
38 shall be considered to be for or in direct
relation to lobbying.
39 (B) Any report of
expenditures for food and beverages shall include
40 the amount expended on a state officer
or employee and guests of such
41 officer or employee. Such report shall
include the name of such officer or
42 employee and the number of guests of the
officer or employee. The pro-
43 visions of this subsection (B) shall not
apply to:

1 (i) Food and
beverages, the provision of which is motivated by a per-
2 sonal or family relationship or
provided at events to which all members
3 of the legislature are
invited;
4 (ii) food and
beverages provided at public events in which the person
5 is attending in an official
capacity;
6 (iii) food and
beverages provided to a person subject to this act when
7 it is obvious such food and
beverage are not being provided because of
8 the person's official position;
and
9 (iv) food and
beverages such as soft drinks, coffee or snack foods not
10 offered as part of a meal.
11 (C) Notwithstanding
the requirements of this subsection and subsec-
12 tion (c), no lobbyist shall be responsible
to report any expenditure by the
13 lobbyist's employer of which such person
has no knowledge.
14 (c) Whenever an individual
lobbyist contributes to a single special
15 event, such lobbyist shall report only the
aggregate amount or value of
16 the expenditure contributed by such
lobbyist.
17 (d) Whenever more than one
lobbyist is employed by a single em-
18 ployer, the reports required by this
section relating to such employer shall
19 be made by only one such lobbyist and that
lobbyist shall be the lobbyist
20 who is most directly connected with the
particular expenditure or gift,
21 honoraria or payment. No expenditure or
gift, honoraria or payment re-
22 quired to be reported by this section shall
be reported by more than one
23 lobbyist.
24 (e) All accounts, records and
documents of the lobbyist which relate
25 to every expenditure reported or which
should have been reported shall
26 be maintained and preserved by the lobbyist
for a period of five years
27 from the date of the filing of such report
or statement and may be in-
28 spected under conditions determined by the
commission.
29 Sec. 2. K.S.A. 1997 Supp.
46-269 is hereby repealed.
30 Sec. 3. This act shall take
effect and be in force from and after its
31 publication in the statute book.
