                    HOUSE BILL No. 2598           By Joint Committee on Arts and Cultural Resources           12-17             9             AN ACT concerning mortgage registration fees; relating to disposition
10             thereof; amending K.S.A. 79-3107b and repealing the existing section.

12       Be it enacted by the Legislature of the State of Kansas:
13           Section 1. K.S.A. 79-3107b is hereby amended to read as follows: 79-
14       3107b. (a) Except as provided in subsection (b), The county treasurer
15       shall pay quarterly to the state treasurer, commencing on October 1, 1990
16       July 1, 1998, $.01 of each $.26 paid to the county treasurer during the
17       preceding calendar quarter from mortgage registration fees under K.S.A.
18       79-3101 to 79-3107, inclusive, and amendments thereto, and credited to
19       the county general fund under K.S.A. 79-3104 and amendments thereto.
20       All such moneys paid to the state treasurer shall be deposited in the state
21       treasury and credited to the heritage trust fund.
22           (b) No payments under subsection (a) shall be made by the county
23       treasurer to the state treasurer during any calendar year in excess of a
24       total of $100,000. All moneys collected in excess of this amount which
25       under subsection (a) would be paid to the state treasurer shall be credited
26       to the county general fund.
27           Sec. 2. K.S.A. 79-3107b is hereby repealed.
28           Sec. 3. This act shall take effect and be in force from and after its
29       publication in the statute book.
