9 A PROPOSITION to amend section 2 of article 13 of the constitution of
10 the state of Kansas, relating to banks.

12 Be it resolved by the Legislature of the State of Kansas, two-thirds of the
13 members elected (or appointed) and qualified to the Senate and two-
14 thirds of the members elected (or appointed) and qualified to the House
15 of Representatives concurring therein:
16 Section 1. The following proposition to amend the constitution of the
17 state of Kansas shall be submitted to the qualified electors of the state
18 for their approval or rejection: Section 2 of article 13 of the constitution
19 of the state of Kansas is hereby amended to read as follows:
20 (section) 2. State not to be stockholder. The state shall not be a stock-
21 holder in any banking institution, except that any retirement or pension
22 plan authorized pursuant to the laws of this state may be a stockholder
23 in any banking institution.
24 Sec. 2. The following statement shall be printed on the ballot with
25 the amendment as a whole:
26 ``Explanatory statement. The purpose of this amendment is to allow
27 any retirement or pension plan authorized pursuant to the laws of this
28 state to be a stockholder in any banking institution.
29 ``A vote for this amendment would allow any retirement or pension
30 plan authorized pursuant to the laws of this state to be a stockholder
31 in any banking institution.
32 ``A vote against this amendment favors retaining the current prohi-
33 bition against the state and any retirement or pension plan authorized
34 pursuant to the laws of this state from being a stockholder in any
35 banking institution.''
36 Sec. 3. This resolution, if approved by two-thirds of the members
37 elected (or appointed) and qualified to the Senate and two-thirds of the
38 members elected (or appointed) and qualified to the House of Repre-
39 sentatives, shall be entered on the journals, together with the yeas and
40 nays. The secretary of state shall cause this resolution to be published as
41 provided by law and shall cause the proposed amendment to be submitted
42 to the electors of the state at the general election in the year 1998 unless
43 a special election is called at a sooner date by concurrent resolution of

1 the legislature, in which case it shall be submitted to the electors of the
2 state at the special election.
