SENATE BILL No. 94

AN ACT concerning insurance; agents, nonresident agents and insurance
brokers; applicants for licensure.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) The commissioner of insurance shall implement meth-
ods and procedures to ensure that any person who is an applicant or a
licensed insurance agent under this act, an applicant or nonresident in-
surance agent pursuant to K.S.A. 40-246 and amendments thereto or an
applicant or licensed insurance broker pursuant to K.S.A. 40-3701 et seq.
and amendments thereto, is provided an opportunity, in a clear and con-
spicuous manner, to prohibit the disclosure by the insurance department
of such person's social security number, birthdate, home address and
telephone number, except:
(1) For use by any government agency, including any state, federal
or local court or law enforcement agency, in carrying out its functions or
any private person or entity acting on behalf of a federal, state or local
agency in carrying out its functions;
(2) for use in connection with any civil, criminal, administrative or
arbitration proceeding in any federal, state or local court or agency or
before any selfregulating body, including the use of such information in
the service of process, investigations in anticipation of litigation and the
execution of enforcement of judgments and orders, or for use pursuant
to an order of the federal, state or local court;
(3) for use in research activities, or for use in preparing statistical
reports so long as such information is not made public, redisclosed or
used to contact individuals; and
(4) for use by anyone who has obtained the written consent of the
individual to whom the information pertains.
(b) The commissioner of insurance shall comply with subsection (a)
above notwithstanding the provisions of the Kansas open records act,
K.S.A. 45-215 et seq. and amendments thereto.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
