12 AN ACT concerning school districts; relating to the provision of educa-
13 tional services in a regular school setting for certain persons over
14 the age of compulsory school attendance.

16 Be it enacted by the Legislature of the State of Kansas:
17 Section 1. (a) No A school district shall not be required to provide
18 any person who is over the compulsory school attendance age prescribed
19 by K.S.A. 72-1111, and amendments thereto, has attained 21 19 years
20 of age and who is not currently enrolled in the school district with
21 an opportunity to receive educational services in a regular school setting.
22 In lieu of providing any such person with educational services in a regular
23 school setting, and subject to the provisions of subsection (b), a school
24 district may must provide may offer the person with educational services
25 in an alternative setting or with an alternative educational program. The
26 educational services or educational program provided any person as an
27 alternative to regular school placement shall be designed to provide the
28 person with the opportunity to satisfactorily complete the course require-
29 ments of the state board of education necessary for graduation from high
30 school. Whenever a school district provides educational services or edu-
31 cational programs to persons as an alternative to regular school place-
32 ment, such persons shall be subject to the same requirements, terms and
33 conditions of law, rules and regulations and district policies as are appli-
34 cable to persons in regular school placement.
35 (b) The provisions of subsection (a) do not apply to any person who
36 is determined to be an exceptional child, except for an exceptional child
37 who is determined to be a gifted child, under the provisions of the special
38 education for exceptional children act.
39 (b) Whenever a school district provides educational services or
40 educational programs to persons as an alternative to regular school
41 placement, such persons shall be subject to the same requirements,
42 terms and conditions of law, rules and regulations and district pol-
43 icies as are applicable to persons in regular school placement.

1 (c) The foregoing provisions of this section do not apply to per-
2 sons who have been determined to be exceptional children, except
3 gifted children, under the provisions of the special education for
4 exceptional children act. Such persons shall be subject to the pro-
5 visions of their respective individualized education programs.
6 Sec. 2. This act shall take effect and be in force from and after its
7 publication in the statute book.
