14 AN ACT concerning the Governor's mental health services planning 15 council; relating to size, composition and terms of the council; amend- 16 ing K.S.A. 39-1605 and repealing the existing section. 17 18 Be it enacted by the Legislature of the State of Kansas: 19 Section 1. K.S.A. 39-1605 is hereby amended to read as follows: 39- 20 1605. (a) There is hereby established the governor's mental health serv- 21 ices planning council. The council shall consist of 28 22 23 25 members 22 appointed by the governor, of which not more than 13 members shall be 23 state officers or employees or providers of mental health services. The 24 members shall be appointed by the governor 25 (b) So that the composition of the council is in compliance with the 26 requirements of public law 99-660 102-321 and supplementary federal 27 acts and, persons appointed to the council will be in accordance with the 28 following: 29 (1) Eight Nine members shall be representatives of state agencies; 30 state agency representatives who shall include: 31 (A) The commissioner of mental health and developmental disabili- 32 ties; 33 (B) the secretary of social and rehabilitation services shall appoint 34 one member for each of the following areas: vocational rehabilitation, 35 alcohol and drug abuse services, medical services and children and family 36 services; 37 (C) the Kansas youth authority shall appoint one member [the 38 commissioner of juvenile justice]; 39 (C) (D) the commissioner of education; 40 (D) (E) the secretary of corrections; and 41 (E) (F) the secretary of commerce and housing. 42 If a commissioner or secretary is unable to participate, the commissioner 43 or secretary shall appoint a designee as the official member of the council.  1    (2)  one member shall be a representative of private mental health
 2  service providers; The governor shall appoint the following persons to the
 3  council:
 4    (3) (A)  One member shall be a person licensed to practice medicine
 5  and surgery with board certification in psychiatry;
 6    (4)  two members shall be members of governing boards of mental
 7  health centers;
 8    (5) (B)  two members shall be executive directors of mental health
 9  centers; and
10    (6)  fourteen (C)  eleven 13 members shall be members of the gen-
11  eral public and a majority of such members shall be consumers of mental
12  health services and family members of mentally ill persons. individuals
13  who are not state employees or providers of mental health services. Of
14  the 11 13 members, four members shall be adult consumers with serious
15  and persistent mental illness who are receiving or have received mental
16  health services; three members shall be parents of adult immediate fam-
17  ily members of adult consumers with serious and persistent mental
18  illnesses; and four members shall be parents family members of minor
19  children or youth with serious severe emotional disturbances; and two
20  members shall be members of the general public.
21    (b)  The governor shall designate the chairperson of the governor's
22  mental health services planning council.
23    (c)  The terms of members who are currently serving on the council
24  shall expire on the effective date of this act. At that time, appointees of
25  the governor under subsection (b)(2) shall be appointed to the council by
26  the governor with 1/2 appointed for a term of two years and the other 1/2
27  for a term of four years as specified by the governor. Thereafter, each
28  member appointed to the council by the governor shall be appointed for
29  a term of four years.
30    (d)  Each member of the council shall serve until a successor is ap-
31  pointed and qualified. Each member of the governor's mental health serv-
32  ices planning council shall be appointed for a term of four years. In the
33  case of a vacancy on the council, the governor shall appoint a successor
34  for of like qualifications shall be appointed or designated to fill the unex-
35  pired term in the same manner as the original appointment accordance
36  with subsections (b)(1) and (2).
37    (e)  The governor shall designate the chairperson of the council. The
38  members of the governor's mental health services planning council shall
39  elect a vice-chairperson.
40    (c) (f)  Members of the governor's mental health services planning
41  council attending meetings of the council, or attending a subcommittee
42  meeting thereof authorized by the council, shall be paid amounts pro-
43  vided in subsection (e) of K.S.A. 75-3223 and amendments thereto.

 1    Sec. 2.  K.S.A. 39-1605 is hereby repealed.
 2    Sec. 3.  This act shall take effect and be in force from and after its
 3  publication in the statute book.
